`- 0 ORDINANCE NO. 3551 AN ORDINANCE providing for the improvement of DELAWARE AVENUE from 48th St. to 52nd St. end 50th STREET from the alley west of Delaware Avenue to the alley east of Delaware Avenue by the construction of a concrete sidewalk and concrete curbs and gutters on both sides of the street and 52nd St. from Delaware Avenue to the alley east of Delaware Ave. by the construction of a concrete sidewalk and concrete curbs and gutters on the north side only; by such grading or regrading as may be necessary, by the installation of necessary drainage or the removal and replacement of existing drainage and doing such other work as may be necessary in connection therewith, all in accordance with a majority petition therefor, creating a local improvement district, creating a local improvement fund and providing for payment of said improvement by special assessment on the property in said district under the mode of payment by bonds. WHEREAS, there has been heretofore filed with the City Council of the City of Everett a majority petition of the property owners petitioning for said improvement, and upon examination thereof the said City Council has found the things set forth therein to be true, and WHEREAS, the said petition has been referred to the Commissions of Public Works to be examined by said Commissioner and the C' y Engineer, and the Commissioner of Public Works has filed wixt/ the City Council all data and information required by law; NOW TIEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1 : That DELAWARE AVENUE from 48th St. to 52nd St. , and 50th STREET from the alley west of Delaware Avenue to the alley east of Delaware Avenue be improved by the construction of a concrete sidewalk and concrete curbs and gutters on both sides of the street and 52nd St, from Delaware Avenue to the alley east of Delaware Ave. by the construction of a concrete sidewalk and concrete curbs and gutters on the north side only; by such grading or regrading as may be necessary,by the installation of necessary drainage or the removal and replacement of existing drainage and doing such other work as may be necessary in connection therewith, all according to the plans and specifications prepared under the direction of the City Engineer and which plans and specifications are hereby approved and adopted. Section 2 : That the cost and expense of such improvement including all necessary incidental expenses, shall be borne by and assessed against the property included in the assessment district herein created in accordance with the special benefits conferred without regard to the zone and termini method of spreading assessments. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement, except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto, and the ordinances of the City of Everett. f Section 3: That there is hereby established a local improvement district to be known as "Local Improvement District No. 639 ", which district shall include the following , described property located in Everett, Snohomish County, Washingto : -1-
