`- <br /> 0 <br /> ORDINANCE NO. 3551 <br /> AN ORDINANCE providing for the improvement of <br /> DELAWARE AVENUE from 48th St. to 52nd St. end <br /> 50th STREET from the alley west of Delaware Avenue to <br /> the alley east of Delaware Avenue <br /> by the construction of a concrete sidewalk and concrete curbs <br /> and gutters on both sides of the street and 52nd St. from <br /> Delaware Avenue to the alley east of Delaware Ave. by the <br /> construction of a concrete sidewalk and concrete curbs and gutters <br /> on the north side only; by such grading or regrading as may be <br /> necessary, by the installation of necessary drainage or the <br /> removal and replacement of existing drainage and doing such other <br /> work as may be necessary in connection therewith, all in accordance <br /> with a majority petition therefor, creating a local improvement <br /> district, creating a local improvement fund and providing for <br /> payment of said improvement by special assessment on the property <br /> in said district under the mode of payment by bonds. <br /> WHEREAS, there has been heretofore filed with the City <br /> Council of the City of Everett a majority petition of the <br /> property owners petitioning for said improvement, and upon <br /> examination thereof the said City Council has found the things <br /> set forth therein to be true, and <br /> WHEREAS, the said petition has been referred to the <br /> Commissions of Public Works to be examined by said Commissioner <br /> and the C' y Engineer, and the Commissioner of Public Works has <br /> filed wixt/ the City Council all data and information required by <br /> law; <br /> NOW TIEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1 : That <br /> DELAWARE AVENUE from 48th St. to 52nd St. , and <br /> 50th STREET from the alley west of Delaware Avenue to <br /> the alley east of Delaware Avenue <br /> be improved by the construction of a concrete sidewalk and <br /> concrete curbs and gutters on both sides of the street and 52nd <br /> St, from Delaware Avenue to the alley east of Delaware Ave. by <br /> the construction of a concrete sidewalk and concrete curbs and <br /> gutters on the north side only; by such grading or regrading <br /> as may be necessary,by the installation of necessary drainage <br /> or the removal and replacement of existing drainage and doing <br /> such other work as may be necessary in connection therewith, all <br /> according to the plans and specifications prepared under the <br /> direction of the City Engineer and which plans and specifications <br /> are hereby approved and adopted. <br /> Section 2 : That the cost and expense of such improvement <br /> including all necessary incidental expenses, shall be borne by <br /> and assessed against the property included in the assessment <br /> district herein created in accordance with the special benefits <br /> conferred without regard to the zone and termini method of <br /> spreading assessments. The City of Everett shall not be liable <br /> in any manner for any portion of the costs and expenses of such <br /> improvement, except as provided by Chapter 141, Session Laws of <br /> 1923, or acts amendatory thereto, and the ordinances of the City <br /> of Everett. f <br /> Section 3: That there is hereby established a local <br /> improvement district to be known as "Local Improvement District <br /> No. 639 ", which district shall include the following <br /> , described property located in Everett, Snohomish County, Washingto : <br /> -1- <br />
