4i ORDINANCE NO. 3553 AN ORDINANCE providing for the improvement of: ALGER AVENUE from LI.7th St. to Evergreen Way by the construction of portland cement concrete curbs and 18" gutters and including as a part of said work the construction or reconstruction, where necessary, of all sewers, side sewers, water mains and hydrants with necessary appurtenances, by such grading or regrading as may be necessary, installation of necessary drainage and doing such other work as may be necessary in connection therewith in accordance with plans prepared by the City Engineer. WHEREAS, there has been heretofore filed with the City Council of the City of Everett a majority petition of the pro- perty owners petitioning for said improvement, and upon examina- tion thereof the said City Council has found the things set forth therein to be true, and WHEREAS, the said petition has been referred to the Commissioner of Public Works to be examined by said Commissioner and the City Engineer, and the Commissioner of Public Works has filed with the City Council all data and information required by law, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That ALGER AVENUE from 47th St. to Evergreen Way be improved by the construction of portland cement concrete curbs and 18" gutters and including as a part of said work the con- struction or reconstruction, where necessary, of all sewers, side sewers, water mains and hydrants with necessary appurtenances, by such grading or regrading as may be necessary, installation of necessary drainage and doing such other work as may be necessary in connection therewith, all according to the plans and specifications prepared under the direction of the City Engineer and which plans and specifications are hereby approved and adopted. section 2: That the cost and expense of such improve- ment, including all necessary incidental expenses, shall be borne by and assessed against the property included in the assessment district herein created in accordance with the special benefits conferred without regard to the zone and termini method of spreading assessments . The City of Everett shall not be liable in any manner for any portion of the costa and expenses of such improvement, except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto, and the ordinances of the City of Everett. Section 3: That there is hereby established a local improvement district to be known as "Local Improvement District No. 638 " , which district shall include the following describe , property located in Everett, Snohomish County, Washington: Easterly 2 ft. of Lots 1 to LF, inc. , Blk. 3, Plat of Vista Heights; Lot 5, less the Easterly 20 ft. , Elk. 3, Plat of Vista Heights; Lot 6, less the Easterly 20 ft. , Elk. 3, Plat of Vista Heights
