4i <br /> ORDINANCE NO. 3553 <br /> AN ORDINANCE providing for the improvement of: <br /> ALGER AVENUE from LI.7th St. to Evergreen Way <br /> by the construction of portland cement concrete curbs and 18" <br /> gutters and including as a part of said work the construction or <br /> reconstruction, where necessary, of all sewers, side sewers, <br /> water mains and hydrants with necessary appurtenances, by such <br /> grading or regrading as may be necessary, installation of <br /> necessary drainage and doing such other work as may be necessary <br /> in connection therewith in accordance with plans prepared by the <br /> City Engineer. <br /> WHEREAS, there has been heretofore filed with the City <br /> Council of the City of Everett a majority petition of the pro- <br /> perty owners petitioning for said improvement, and upon examina- <br /> tion thereof the said City Council has found the things set <br /> forth therein to be true, and <br /> WHEREAS, the said petition has been referred to the <br /> Commissioner of Public Works to be examined by said Commissioner <br /> and the City Engineer, and the Commissioner of Public Works has <br /> filed with the City Council all data and information required by <br /> law, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That <br /> ALGER AVENUE from 47th St. to Evergreen Way <br /> be improved by the construction of portland cement concrete curbs <br /> and 18" gutters and including as a part of said work the con- <br /> struction or reconstruction, where necessary, of all sewers, side <br /> sewers, water mains and hydrants with necessary appurtenances, <br /> by such grading or regrading as may be necessary, installation of <br /> necessary drainage and doing such other work as may be necessary <br /> in connection therewith, all according to the plans and <br /> specifications prepared under the direction of the City Engineer <br /> and which plans and specifications are hereby approved and <br /> adopted. <br /> section 2: That the cost and expense of such improve- <br /> ment, including all necessary incidental expenses, shall be borne <br /> by and assessed against the property included in the assessment <br /> district herein created in accordance with the special benefits <br /> conferred without regard to the zone and termini method of <br /> spreading assessments . The City of Everett shall not be liable <br /> in any manner for any portion of the costa and expenses of such <br /> improvement, except as provided by Chapter 141, Session Laws of <br /> 1923, or acts amendatory thereto, and the ordinances of the City <br /> of Everett. <br /> Section 3: That there is hereby established a local <br /> improvement district to be known as "Local Improvement District <br /> No. 638 " , which district shall include the following describe , <br /> property located in Everett, Snohomish County, Washington: <br /> Easterly 2 ft. of Lots 1 to LF, inc. , Blk. 3, <br /> Plat of Vista Heights; <br /> Lot 5, less the Easterly 20 ft. , Elk. 3, <br /> Plat of Vista Heights; <br /> Lot 6, less the Easterly 20 ft. , Elk. 3, <br /> Plat of Vista Heights <br />
