- e • ORDINANCE NO. 3549 AN ORDINANCE providing for the improvement of FIFTIETH STREET from the alley west of Rucker Avenue to the alley east of Rucker Avenue on the south side of the street only, and FIFTY-SECOND STREET from the alley west of Rucker Avenue to the alley east of Rucker Avenue on the north side of the street only, and RUCKER AVENUE from 50th Street to 52nd Street on both sides of the street by the construction of a portland cement concrete sidewalk and curbs and gutters, by such grading or regrading as may be necessary, by the installation of necessary drainage or the removal and re-installation of existing drainage and doing such other work as may be necessary in connection therewith according to plans prepared by the City Engineer. WHEREAS, there has been heretofore filed with the City Council of the City of Everett a majority petition of the pro- perty owners petitioning for said improvement, and upon examination thereof the said City Council has found the things set forth therein to be true, and WHEREAS, the said petition has been referred to the City Engineer to be examined by said City Engineer, and the City Engineer has filed with the City Council all data and information required by law, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That: FIFTIETH STREET from the alley west of Rucker Avenue to the alley east of Rucker Avenue on the south side of the street only, and FIFTY-SECOND STREET from the alley west of Rucker Avenue to the alley east of Rucker Avenue on the north side of the street only, and RUCKER AVENUE from 50th Street to 52nd Street on both sides of the street be improved by the construction of a portland cement concrete sidewalk and curbs and gutters, by such grading or regrading as may be necessary, by the installation of necessary drainage or the removal and re-installation of existing drainage and doing such other work as may be necessary in connection therewith according to plans prepared by the City Engineer, which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of such improvement, including all necessary incidental expenses, shall be borne, by and assessed against the property included in the assessment district herein created in accordance with the special benefits conferred thereon without regard to the zone and termini method of spreading assessments as provided for in the Laws of 1947, Chapter 155, Section 1, page 717, Laws of the State of Washington.
