- e <br /> • <br /> ORDINANCE NO. 3549 <br /> AN ORDINANCE providing for the improvement of <br /> FIFTIETH STREET from the alley west of Rucker <br /> Avenue to the alley east of Rucker Avenue on the <br /> south side of the street only, and <br /> FIFTY-SECOND STREET from the alley west of <br /> Rucker Avenue to the alley east of Rucker Avenue <br /> on the north side of the street only, and <br /> RUCKER AVENUE from 50th Street to 52nd Street <br /> on both sides of the street <br /> by the construction of a portland cement concrete sidewalk and <br /> curbs and gutters, by such grading or regrading as may be <br /> necessary, by the installation of necessary drainage or the <br /> removal and re-installation of existing drainage and doing such <br /> other work as may be necessary in connection therewith according <br /> to plans prepared by the City Engineer. <br /> WHEREAS, there has been heretofore filed with the City <br /> Council of the City of Everett a majority petition of the pro- <br /> perty owners petitioning for said improvement, and upon <br /> examination thereof the said City Council has found the things <br /> set forth therein to be true, and <br /> WHEREAS, the said petition has been referred to the City <br /> Engineer to be examined by said City Engineer, and the City <br /> Engineer has filed with the City Council all data and information <br /> required by law, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That: <br /> FIFTIETH STREET from the alley west of Rucker Avenue <br /> to the alley east of Rucker Avenue on the south side <br /> of the street only, and <br /> FIFTY-SECOND STREET from the alley west of Rucker <br /> Avenue to the alley east of Rucker Avenue on the north <br /> side of the street only, and <br /> RUCKER AVENUE from 50th Street to 52nd Street on <br /> both sides of the street <br /> be improved by the construction of a portland cement concrete <br /> sidewalk and curbs and gutters, by such grading or regrading as <br /> may be necessary, by the installation of necessary drainage or <br /> the removal and re-installation of existing drainage and doing <br /> such other work as may be necessary in connection therewith <br /> according to plans prepared by the City Engineer, which plans and <br /> specifications are hereby adopted and approved. <br /> Section 2: That the cost and expense of such improvement, <br /> including all necessary incidental expenses, shall be borne, by <br /> and assessed against the property included in the assessment <br /> district herein created in accordance with the special benefits <br /> conferred thereon without regard to the zone and termini method <br /> of spreading assessments as provided for in the Laws of 1947, <br /> Chapter 155, Section 1, page 717, Laws of the State of Washington. <br />
