I <br /> i <br /> • <br /> ORDINANCE NO. 3505 <br /> AN ORDINANCE PROVIDING FOR TIC EXTENSION TO TLIE CITY <br /> E, IPLOYEES OF THE CITY OF EVERETT COVERED BY URL STATE EiTLOYEES <br /> RE`l'IRL' LU T SYSTLI',1 LAE BENEFIT Or OLD AGE .L,D SURVIVOR INSJ A.Au CE AS <br /> PROVIDED BY TEE SOCIAL SECURITY ACT OF T1,E UNITED ST-=' TES EFFECTIVE <br /> AS OF JANUARY 1, 1955; DECLARING AN PV RGENCY; AND ALLOCATING FUNDS <br /> TO COVER COSTS OF PARTICIPATION BY THE CITY OF EVERETT. <br /> WHEREAS, the Commissioners of the Olt-7 of Everett at the <br /> time of the making of the budget for the year 1955 determined to <br /> provide to the city employees covered under the state mployees <br /> Retirement System with additional coverage of social security <br /> effective January 1, 1955, if the State laws of the State of vash- <br /> ington should be so amended as to -provide for such coverage, and <br /> WHEREAS, the Legislature, Chanter 4, Laws of Extraordinary <br /> Session, 1955, provided that city employees now covered under the <br /> State Employees Retirement System may be covered by social security <br /> if properly approved by the employees, and <br /> IEhEAS, no funds were allocated as no law existed upon <br /> which an allocation could be made, <br /> NON, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That an emergency is hereby declared to exist <br /> and the sum of 4 17,500.00 is hereby an_ propriated out of the <br /> City of mverett mployees' Retirement 1''und to cover the participating <br /> costs and administrative costs of the City of .Lverett for its <br /> employees to be covered under provisions of the Old Age and Survivor <br /> Insurance as provided by the Social Security Act of the United <br /> States effective as of January- 1, 1955 for the year 1955. That each <br /> year thereafter the City Commissioners shall provide in the annual <br /> budget sufficient funds to pay the City' s participating and adminis- <br /> trative costs for this coverage. <br /> Section 2: That a referendum be submitted to all em- <br /> ployees of the City of Everett, now covered under the State <br /> Employees Retirement System, as shall be directed by Chapter 4, <br /> Laws of Extraordinary Session, 1955, and the Governor of the State <br /> of 'rashington, on the question of whether or not said employees <br /> desire to be excluded from or included under the provisions of the <br /> Old Age and Survivor Insurance System embodied in the Social <br /> Security Act of the United States. <br /> Section 3: That in event the qualified employees of the <br /> City of Everett shall elect to be covered under provisions of the <br /> Old Age and Survivor Insurance System as embodied in the Social <br /> Security Act of the United States the City Clerk shall deduct from <br /> such employee ' s salary the amount of the employee ' s tax which is <br /> imposed by the Federal Insurance Contribution Act and the amount <br /> deducted from such wages shall be paid to the O.A.S.I. Contribution <br /> Fund in partial discharge of the liability of the City of Everett. <br /> Failure to deduct such contribution shall not relieve the employee <br /> or employer of liability therefor.
