, <br /> r , <br /> ORDINANCE NO. 3498 <br /> AN ORDINANCE relating to residential and commercial driveway <br /> approaches and curb cuts; regulating size, location, number and <br /> construction of same; providing for variances; providing for re- <br /> placement of driveway approaches; providing for issuance of permits <br /> and fixing fees; providing a penalty for the violation of this <br /> ordinance and repealing Ordinance No. 2610 and all other ordinances <br /> and parts of ordinances in conflict herewith. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: DEFINITIONS. For the purpose of this ordinance <br /> the following definitions shall apply: <br /> (a) Driveway. A driveway is an area on private property <br /> where automobiles and other vehicles are operated or <br /> allowed to stand. <br /> (b) Driveway Approach. Driveway approach is an area,con- <br /> struction or improvement between the roadway of a <br /> public street and private property intended to provide <br /> access for vehicles from the roadway of a public street <br /> to a definite area of the private property, such as a <br /> parking area, a driveway or a door at least seven <br /> feet (7' ) wide intended and used for the ingress and <br /> egress of vehicles. The component parts of the drive- <br /> way approach are termed the apron, the end slopes or <br /> the curb return and sidewalk section. <br /> (e) Apron. The apron is that portion of the driveway <br /> approach extending from the gutter flow line to the <br /> sidewalk section and lying between the end slopes of <br /> the driveway approach. <br /> (d) End Slopes. The end slopes are those portions of the <br /> driveway approach which provide a transition from the <br /> normal curb and sidewalk elevations to the grade of <br /> the apron, either by means of a sloping surface or <br /> by means of a curb return, together with the area be- <br /> tween the projected tangents of the curb return. <br /> (e) Sidewalk Section. The sidewalk section is that por- <br /> tion of the driveway approach lying between the <br /> back edge of the sidewalk and the apron, plus the <br /> end slopes measured at the front edge of the side- <br /> walk. <br /> (f) Curb Return. The curb return is the curved portion <br /> of a street curb at street intersections, or the <br /> curved portion of a curb in the end slopes of a <br /> driveway approach. <br /> Section 2: PEP IT REQUIRED. No person, firm or corpora- <br /> tion shall remove, alter or construct any curb, sidewalk, driveway <br /> approach, gutter, pavement or other improvement in any public street, <br /> alley or other property owned by or dedicated to or used by the City <br /> and over which it has jurisdiction to regulate the matters covered <br /> hereby, without first obtaining a permit from the City Engineer, <br /> and no permit shall be granted until the applicant shall file with <br /> the City Engineer for his approval a copy of a drawing showing the <br /> location and size of all such proposed improvements to serve the <br /> property affected. <br />
