• • <br /> 4 <br /> Section 10: It shall be unlawful to suffer or permit any <br /> animal, reptile or fowl to trespass on private or public property <br /> so as to damage or destroy any property or thing of value and <br /> same is hereby declared to be a nuisance and any such animal, <br /> reptileor fowl may be impounded by the poundmaster. whenever it <br /> shall be affirmed in writing by 3 or more persons having separate <br /> residences, or regularly employed in the neighborhood that any <br /> animal, reptile or fowl is a habitual nuisance by reason of <br /> trespassing, howling, barking or other noise, or damage to property, <br /> being vicious or by its actions potentially vicious or in any other <br /> manner causing undue annoyance, the poundmaster if he finds such <br /> nuisance to exist in fact, shall serve notice upon the owner or <br /> custodian that such nuisance must be abated within 48 hours, after <br /> which the poundmaster shall decide whether such nuisance has been <br /> abated and if not, any such animal shall be impounded. Refusal to <br /> release to the poundmaster any such animal, reptile or fowl shall <br /> constitute a violation of this ordinance. <br /> Section 11; It shall oe unlawful to permit any dog or <br /> other animal whether licensed or not to run at large in any park, <br /> or to enter any public beach, pond, fonntain or stream therein, or <br /> upon any public playground or school ground; or to tie or tether <br /> any animal on any street or public place or any unenclosed lot or <br /> Premises in such manner as to permit such animal to enter any <br /> sidewalk, street, alley or other public place or upon any adjoining <br /> lot orpremises. <br /> Section 12: An advisory committee of 3 members, shall be <br /> appointed, one by the Director of Public Health, one by the Chief <br /> of Police and one by the poundmaster, subject to approval by the <br /> the City Council, each to serve for one year. The committee shall <br /> meet at least once each month and shall discuss and review any <br /> problems arising from the enforcement of this ordinance. At each <br /> such monthly meeting the poundmaster shall submit an accounting in <br /> writing of the previous month's activities, <br /> Section 13: Should any part of this ordinance be adjudged <br /> invalid for any reason, such adjudication shall not affect the <br /> validity of this ordinance as a whole or any other part thereof. <br /> Section 14: The violation of or failure to comply with any <br /> of the provisions of this ordinance shall be punishable by a fine <br /> not exceeding 000.00 or by imprisonment in the City Jail for a <br /> term not exceeding 90 days, or by both such fine and imprisonment. <br /> Section 15: an emergency is hereby declared to exist and <br /> this ordinance shall take effect on January 1, 1955. <br /> f/A / / / <br /> 47 yo r <br /> Attest: <br /> Rif, 4Y. <br /> City C .er <br /> Passed: D(,c. 14, 195) <br /> Published: Doc . 15, 1954 <br />
