ORDINANCE NO. C ` AY ORDINANCE providing for the improvement of: FIFTIETH STREET from Evergreen Way to the alley west of Wilmington Avenue on both sides of the street, and FIFTIETH STREET from the alley west of Wilmington Avenue to the alley east of Wilmington Avenue on the north side of the street only I by the construction of concrete sidewalks and concrete curbs and { gutters, by such grading or regrading as may be necessary,by the installation of necessary drainage or the removal and reinstallation of existing drainage and doing such other work as may be necessary in connection therewith. WHEREAS, there has been heretofore filed with the City Council of the City of Everett a majority petition of the property ` owners petitioning for said improvement, and upon examination thereof the said City Council has found the things set forth therein JJ+ to be true, and WHEREAS, the said Petition has been referred to the Commissioner of Public Works to be examined by said Commissioner and the City Engineer, and the Commissioner of Public Works has filed with the City Council all data and information required by law, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That: FIFTIETH STREET from Evergreen Way to the alley west of Wilmington Avenue on both sides of the street, and FIFTIETH STREET from the alley west of Wilmington Avenue to the alley east of Wilmington Avenue on the north side of the street only be improved by the construction of concrete sidewalks and concrete curbs and gutters; by such grading or regrading as may be necessary; by the installation of necessary drainage or the removal and re- installation of existing drainage and doing such other work as may be necessary in connection therewith; all according to the plans and specifications prepared under the direction of the City Engineer and which plans and specifications are hereby adopted and approved. Section 2: That the cost and expenses of such improvement, including all necessary incidental expenses, shall be borne by and assessed against the property included in the assessment district herein created in accordance with the special benefits conferred without regard to the zone and termini method of spreading assess- ments. The City of Everett shall not be liable in any manner for any. portion of the costs and expenses of such improvement, except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto, and the ordinances of the City of Everett. Section 3: That there is hereby established a local improveent district to be known as "Local Improvement District No. v ", which district shall include the following described property located in Everett, Snohomish County, Washington, to-wit:
