ORDINANCE NO. C <br /> ` AY ORDINANCE providing for the improvement of: <br /> FIFTIETH STREET from Evergreen Way to the alley west of <br /> Wilmington Avenue on both sides of the <br /> street, and <br /> FIFTIETH STREET from the alley west of Wilmington Avenue <br /> to the alley east of Wilmington Avenue <br /> on the north side of the street only <br /> I by the construction of concrete sidewalks and concrete curbs and <br /> { gutters, by such grading or regrading as may be necessary,by the <br /> installation of necessary drainage or the removal and reinstallation <br /> of existing drainage and doing such other work as may be necessary <br /> in connection therewith. <br /> WHEREAS, there has been heretofore filed with the City <br /> Council of the City of Everett a majority petition of the property <br /> ` owners petitioning for said improvement, and upon examination <br /> thereof the said City Council has found the things set forth therein <br /> JJ+ to be true, and <br /> WHEREAS, the said Petition has been referred to the <br /> Commissioner of Public Works to be examined by said Commissioner and <br /> the City Engineer, and the Commissioner of Public Works has filed <br /> with the City Council all data and information required by law, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That: <br /> FIFTIETH STREET from Evergreen Way to the alley west of <br /> Wilmington Avenue on both sides of the <br /> street, and <br /> FIFTIETH STREET from the alley west of Wilmington Avenue <br /> to the alley east of Wilmington Avenue <br /> on the north side of the street only <br /> be improved by the construction of concrete sidewalks and concrete <br /> curbs and gutters; by such grading or regrading as may be necessary; <br /> by the installation of necessary drainage or the removal and re- <br /> installation of existing drainage and doing such other work as may <br /> be necessary in connection therewith; all according to the plans and <br /> specifications prepared under the direction of the City Engineer and <br /> which plans and specifications are hereby adopted and approved. <br /> Section 2: That the cost and expenses of such improvement, <br /> including all necessary incidental expenses, shall be borne by and <br /> assessed against the property included in the assessment district <br /> herein created in accordance with the special benefits conferred <br /> without regard to the zone and termini method of spreading assess- <br /> ments. The City of Everett shall not be liable in any manner for any. <br /> portion of the costs and expenses of such improvement, except as <br /> provided by Chapter 141, Session Laws of 1923, or acts amendatory <br /> thereto, and the ordinances of the City of Everett. <br /> Section 3: That there is hereby established a local <br /> improveent district to be known as "Local Improvement District <br /> No. v ", which district shall include the following described <br /> property located in Everett, Snohomish County, Washington, to-wit: <br />
