• <br /> r • <br /> ORDINANCE NO. 3,177 <br /> AN ORDINANCE of the City of Everett relating to the speed of <br /> locomotives and trains within the corporate limits of the <br /> City of Everett and amending Ordinance No. 264. <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF EVERETT AS FOLLOWS: <br /> Section 1. That Section 1 of Ordinance 264 is hereby amended <br /> to read as follows: <br /> Section 1. Except where an underpass or overpass <br /> exists it shall be unlawful to operate any locomotive or <br /> train over, along or across any street, avenue or alley <br /> within the corporate limits of the City of Everett at a <br /> greater speed than hereinafter prescribed. <br /> (a) That area of the City lying west of Broadway <br /> Avenue, thirty-five (35) miles per hour, except <br /> at Bond Street, Hewitt Avenue, Everett Avenue <br /> and California Avenue where the speed shall not <br /> be greater than twenty-five (25) miles per hour. <br /> (b) That area of the City lying east of Broadway <br /> Avenue? forty-five (45) miles per hour, except <br /> at Pacific Avenue, Hewitt Avenue, Everett Avenue <br /> and California Avenue where the speed shall not <br /> be greater than twenty-five (25) miles per hour. <br /> Section 2. That Section 2 of Ordinance 264 is hereby amended <br /> to read as follows: <br /> Section 2. Every person or corporation (including <br /> officers or employees thereof) who shall violate the pro- <br /> visions of Section 1 of this ordinance, shall be deemed <br /> guilty of a misdemeanor and upon conviction thereof shall <br /> be adjudged to pay a fine of not less than Ten Dollars <br /> ($10) nor more than One Hundred Dollars ($100) , and the <br /> costs of prosecution, or in default of the payment of said <br /> fine and costs, be imprisoned for a period of time not <br /> exceeding one day for each Three Dollars ($3) of said fine <br /> and costs. <br /> Section 3. This ordinance shall take effect and be in force <br /> from and after the expiration of thirty (30) days after the date <br /> of publication as provided by the City Charter. <br /> Passed by the Council of the City of Everett, this 2.27� day <br /> of ju y 1954, and signed by me in open session in <br /> authentication of its passage. <br /> i .
