ORDINANCE NO. 3475 AN ORDINANCE providing for the improvement of ''>'ILMINGTON AVENUE from 50th Street to 52nd ')treet by the construction of a concrete sidewalk and concrete curbs and gutters on both sides of the street and FIFTIETH STREET from the alley west of `•` ilmington Ave. to the alley east of filmington Hve. by the construction of a concrete sidewalk and concrete curbs and gutters on the south side of the street only, by such grading or regrading as may be necessary, by the installation of necessary drainage or the removal and replacement of existing drainage and doing such other work as may be necessary in connection therewith. WHEREAS there has been heretofore filed with the City Council of the city of Everett a majority petition of the property owners petitioning for said improvement, and upon examination thereof the said city Council has found the things set forth therein to be true, and t"vh r ,5, the said Petition has been referred to the City Engineer to be examined by saidCity Engineer, and the City Engineer has filed with the City Council all data and information required by law, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That an improvement be made of: ILMINGTUN AVENUE from 50th Street to 52nd Street by the construction of a concrete sidewalk and concrete curbs and gutters on both sides of the street and FIFTIETH STREET from the alley west of 'srilmington Ave. to the alley east of ,ilmington Ave. by the con- struction of a concrete sidewalk and concrete curbs and gutters on the south side of the street only, by such grading or regrading as may be necessary, by the installation of necessary drainiage or the removal and replacement of existing drainage and doing such other work as may be necessary in connection therewith. all according to the plans and specifications of the City Engineer and which plans and specifications are hereby adopted and approved. Section 2: That the cost and e (pense of such improvement, including all necessary incidental e penses, shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto and the ordinances of the City of Everett. Section 3: That there is hereby established a local im- k provement district to be known as "Local Improvement district No. 632 us which district shall include the following described property located in Everett, Snohomish County, 44ashington, to-wit : Lots 51 to 62, inc. , Plat of Claremont heights Lots 76 to 87, inc. , Plat of Claremont Heights
