CITY OF EVERETT - ORDINANCE NO. 3474 <br /> AN ORDINANCE renewing the provisions of Ordinance No. 578 and grant- <br /> ing to the Great Northern Railway Company, its successors or <br /> assigns, the right, privilege and authority to locate, lay down <br /> construct, maintain and operate for a period of twenty-five (25 ) <br /> years from and after this ordinance becomes effective, a rail- <br /> road spur track along, over and across the alley running east <br /> and west in Block 688 of the Plat of Everett, across McDougall <br /> Avenue, and over, along and across the alley running east and <br /> west in Block 689 of the Plat of Everett Division "I" ; which <br /> spur track does extend from the east line of Broadway Avenue in <br /> the City of Everett, 'Washington, along, over and across said <br /> alleys and across said street to a connection with the track of <br /> the Great Northern Railway Company. <br /> THE CITY COUNCIL OF THE CITY OF EVERETT DO ORDAIN AS FOLLOWS: <br /> Section 1. That there is hereby granted to the Great Northern <br /> Railway Company, its successors or assigns, for a period of twenty- <br /> five (25) years from and after the date this ordinance becomes effec- <br /> tive, a right of way for and the right, privilege and authority to <br /> lay down, construct, maintain and operate a spur track over, along <br /> and across the alley running east and west in Block 688 of the Plat <br /> of Everett, across McDougall Avenue, and along, over and across the <br /> alley running east and west in. Block 689 of the Plat of Everett Divi- <br /> sion "I"; extending from the east line of Broadway Avenue in the City <br /> of Everett, Washington along , over and across said alleys and across <br /> said street to a connection with the track of the Great Northern <br /> Railway Company. It is acknowledged that the spur track herein de- <br /> scribed was constructed pursuant to Ordinance No. 578, which expires <br /> on June 13, 1954, and that the tracks described therein are still in <br /> existence and are being maintained and operated by the Great Northern <br /> Railway Company, which desires to continue to maintain and operate <br /> said spur track. <br /> Section 2. That wherever the said track crosses or is to be <br /> crossed by a street or avenue now constructed or to be hereafter con- <br /> structed, LAIN OUT OR EXTENDED, said grantee, its successors or as- <br /> signs, shall plank and keep in repair at least fifteen feet of its <br /> right of way at each crossing, and the said grantee, its successors <br /> -1- <br />
