<br /> AN ORDINANCE GRANTING FOR A PERIOD OF TEN YEARS TO THE WEST

<br /> ' COAST TELEPHONE COMPANY, ITS SUCCESSORS AND ASSIGNS, THE RIGHT,
<br /> PRIVILEGE AND AUTHORITY TO DO A GENERAL TELEPHONE AND TELEGRAPH
<br /> BUSINESS WITHIN THE CITY OF EVERETT; TO CONTINUE TO ?MAINTAIN,
<br /> OPERATE AND TO EXTEND ITS PRESENT TELEPHONE AND TELEGRAPH SYSTEM;
<br /> AYD TO PLACE, ERECT, LAY, MAINTAIN, OPERATE, REPAIR, REMOVE OR
<br /> REPLACE IN, UPON OR UNDER THE STREETS, ALLEYS, PUBLIC HIGHWAYS AND
<br /> PUBLIC GROUNDS OF THE CITY OF EVERETT, POLES, CONDUITS, WIRES,
<br /> CABLES AND OTHER FACILITIES FOR THE TRANSMISSION OF ELECTRICITY FOR
<br /> TELEPHONE AND TELEGRAPH PURPOSES.
<br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN:
<br /> Section 1: That there be , and hereby is granted upon the
<br /> consideration and conditions in this Ordinance contained, to the
<br /> West Coast Telephone Company, a corporation, organized and existing
<br /> under the laws of the State of Washington, its successors and
<br /> assigns, for the period of ten (10) years from and after the effective
<br /> date of this Ordinance, the right , privilege and authority to con-
<br /> struct, install, replace , extend, maintain and operate a general
<br /> telephone and telegraph system and facilities therefor, within the
<br /> City 'of Everett, and place, erect, lay, maintain, and replace in,
<br /> upon, along and under' all of the streets, alleys and other public
<br /> highways of said City, poles, conduits, wires, cables and other
<br /> facilities for the conduct and operation of a general telephone and
<br /> telegraph business and the transmission of electricity therefor.
<br /> The Grantee does hereby agree that after the effective date
<br /> hereof all new poles or extensions, except replacement of damaged
<br /> or deteriorated boles, shall be erected in the public alleys of the
<br /> City of Everett ; and provided further, that when required by public
<br /> convenience or necessity and in the absence of alleys which may be
<br /> suitably used for such purposes, such poles may be erected upon
<br /> public streets or highways.
<br /> Provided still further, however, that if at any time here
<br /> after the City of Everett shall pave any street, alley or highway,
<br /> or portion thereof, cr otherwise permanently improve the same, the
<br /> City shall in such event give the Grantee ninety (90) days notice
<br /> of intention to make such improvement, and shall further give the
<br /> Grantee thirty (30) days notice of the date the improvement shall
<br /> be made. The Grantee shall, within ninety (90) days of notice of
<br /> intention and within thirty (30) days of date improvement shall be
<br /> made , whichever date is the later, either remove and relocate any
<br /> poles of the Grantee so as to conform to the new grade and not
<br /> obstruct the proposed improvement , or the Grantee may, at its
<br /> option, lay down in advance of such change of grade or improvement
<br /> and in such a way as not to delay or interfere with the same , under-
<br /> ground pipes or conduits in such street , alley or public highway,
<br /> or portion thereof, to be so improved.
<br /> Section 2: The exclusive use of the space for the upper
<br /> arm on all poles of the Grantee owned and used in the City of
<br /> Everett exclusively by the Grantee, shall be reserved for the use
<br /> of the City of Everett , if the City desires such use, for the main-
<br /> ,
