0 <br /> t <br /> ORDINANCE NO. 11`4 <br /> AN ORDINANCE PROVIDIdG' FOR THE VACATION OF THE FOLLOW.. <br /> ING DESCRIBED PORTION OF STREET IN THE CITY OF EVERETT, COUNTY OF <br /> SNOHOMISH, STATE OF WASHINGTON, TO-WIT: <br /> The alley in 81k. 10, Central Park Addition to Everett <br /> from Hoyt Ave. , east to the north and south alley. <br /> WHEREAS, the owners of more than two-thirds of the <br /> private property abutting upon the portion of street and alley above <br /> described have duly filed their petition with the City Council of <br /> Everett praying for the vacation of said portion of street and <br /> alley; and <br /> WHEREAS, said City Council of the City of Everett did <br /> by resolution duly adopted, fix the 18th day of December, 1953 at <br /> 10:00 A.M. of said day for the hearing and determination of said <br /> petition; and <br /> WHEREAS, due and legal notice of the time and place of <br /> said hearing and the determination of said petition has been given <br /> by the City Clerk in the manner required by law; and <br /> WHEREAS, at the time and place fixed for hearing <br /> .{ objections to the vacating of the herein described portion of street <br /> and alley were heard and discussed; and <br /> WHEREAS, it now appears to the City Council that said <br /> petition should be granted and said Council does hereby determine <br /> to vacate the above described portion of street and alley, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the portion of street and alley in <br /> the City of Everett, County of Snohomish, State of Washington, <br /> described as follows, to-wit: <br /> The alley in Blk. 10, Central Park Addition to Everett <br /> ii <br /> from Hoyt Ave. , east to the north and south alley, <br /> be, and the same is hereby vacated and the title to the land in <br /> said portion of street and alley above described is hereby declared <br /> to vest in the abutting property owners as provided by law, except <br /> the City of Everett retains an easement under, over and across <br /> said property vacated for the construction, repair and maintenance <br /> of public utilities and services, together with the right to con» <br /> struct sewer lines, water lines and other utility lines under, <br /> over and across said property, and provided further that no build- <br /> ing or structures shall be erected under, over or across said <br /> land to be vacated without first having secured a permit from the <br /> City Engineer of the City of Everett to erect said building or <br /> structure. <br /> • <br /> Mayor <br /> Attest: <br /> City Clerk / <br /> Passed: December 29, 1953 <br /> Published: December 30, 195 3 <br />
