ORDINANCE NO. 3443 <br /> AN ORDINANCE RELATING TO THE HARBOR OF EVERETT ; AUTHOR- <br /> IZING TEE HARBOR 1, AS 'EA Or CITY OF EVERETT AND THE PORT :'ARDEN <br /> TO MALE RULES AN D REGULATIONS RELATING TO THE HARBOR AND MOORING OF <br /> BOATS; FIXING THE PENAL`T'IL : FOR THE VIOLATION THEREOF. <br /> WHEREAS, the City of Everett and the Port of Everett <br /> have jurisdiction of shipping and management of the port docks and <br /> boathaven in the City of Everett, and <br /> '%1IEREAS, certain rules, regulations and authority are <br /> necessary for the benefit of the general public, the lawful users <br /> of the port and City of Everett harbor facilities, <br /> NO ,, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1 That the Harbor aster and/or Port 7�arden <br /> of Everett are authorized to charge rates for the berthage or <br /> mooring of boats according to published rates fixed from time to <br /> time by the Port Of Everett, and in the case of the City of Everett, <br /> berths by the City of Everett. <br /> Section 2: The Harbor Master and/or Port '' arden of the <br /> port are authorized and required to refuse berthage to any boat <br /> owner who neglects or refuses to pay for the berthage and mooring <br /> of any boat, and any owners mho have an account outstanding and <br /> unpaid. <br /> Section 3: No boat is permitted to occupy any berth <br /> until they have first made arrangements with the harbor attendant <br /> and have been allocated a berth. <br /> Section 4: No person shall trespass on Port of Everett <br /> property without permission of the port authorities. <br /> Section 5: Any person using the port facilities and <br /> mooring and berth facilities in such a manner as to damage the same, <br /> shall be required to repair all damage done, and the harbor piaster <br /> and/or Port 'iarden is authorized to hold any boat or ship until <br /> satisfactory arrangements have been made for any damages caused by <br /> said ship. <br /> Section 6: Any boat owner or master is responsible for <br /> observance of all rules of the Port of Everett relating to the <br /> depositing of oil, garbage or refuse within the harbor. <br /> Section 7: vo boat shall be operated within the harbor <br /> at a speed in excess of six(6) miles per hour, and in any event, at <br /> a speed whereby no damage will be caused to any other boats, floats <br /> or equipment. <br /> Section 8: Any person, firm or corporation violating <br /> any of the above provisions of this ordinance shall be subject to a <br /> fine of not to exceed One hundred Dollars ( 100.00) and confinement <br /> in the City Jail of not to exceed thirty (30) days, or by both such <br /> fine er imprisonment.
