ORDINANCE NO. 3421 <br /> AN ORDINANCE PROVIDING FOR THE VACATION OF THE FOLIDWING <br /> DESC-IBED PROPERTY IN THE CITY OF EVERETT, COUNTY OF SNOHOMISH, STATE <br /> OF WASHINGTON, TO-WIT: <br /> Dakota Avenue extending from Virginia <br /> Avenue to ±`ulton Avenue. <br /> WHEREAS, the owners of more than two-thirds of the private <br /> property abutting on said street and alley above described have <br /> duly filed their petition with the City Council of Everett, praying <br /> for the vacation of said street and alley; and <br /> WHEREAS, said City Council of the City of Everett did, by <br /> resolution duly adopted, fix the 29th day of June, 1953, at 10:00 <br /> o ' clock A.M. of said day for the hearing and determination of said <br /> petition; and <br /> WHEREAS, due and legal notice of the time and place of <br /> said hearing and the determination of said petition has been given <br /> by the City Clerk in the manner required by law; and <br /> WHEREAS, at the time and place fixed for hearing no <br /> persons appeared or made objections to the vacating of the herein <br /> described street and alley and no objections of any kind were made <br /> to the granting of said petition ; and <br /> WHEREAS, it now appearing to the City Council that said <br /> petition should be granted and said Council does hereby determine <br /> to vacate the above described property, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the property in the City of Everett, <br /> County of Snohomish, State of Washington, described as follows, <br /> to-wit: <br /> Dakota Avenue extending from Virginia Avenue <br /> to li'ulton Avenue <br /> be, and the same is hereby vacated, and the title to the land in <br /> said street and alley above described is hereby declared vested in <br /> the abutting property owners as provided by law, subject to and except <br /> the City of Everett retains an ease lent under and across said pro- <br /> perty for the construction, repair, maintenance and operation of <br /> !; sewer and water lines, together with the right of egress and ingress <br /> i for said purposes and provided further that no buildings or <br /> structures shall be built over said property without the consent of <br /> and approval of the City Angineer of the City of Everett. <br /> Mayo <br /> is <br /> Attest <br /> City ,Cler, <br /> Passed: July 14, 1.953 <br /> Published: July 15, 1953 <br />
