ORDINANCE NO. 3396 AN ORDINANCE PROVIDING FOR THE VACATION OF THE FOLLOWING DESCRIBED PROPERTY IN THE CITY OF EVER±taT, COUNTY OF SNOHOMISH, STATE OF WASHINGTON, TO-WIT: Beginning at the Northwest corner of Lot 53, South Highway Addition to Everett; thence South 5° 46' Vest along the West line of Lots 45 to 53, inclusive, as platted, for 214.00 feet to a point of tangency of a curve to the right; thence in a Southwesterly direction and following the arc of a curve to the right having a radius of 5569.65 feet and consuming an angle of 4° 30' 10" for an arc distance of 437.70 feet to an inter- section with the North boundary of Cascade Terrace Addition produced Easterly; thence South 89° 10' 30" iyest along said north boundary for 10.14 feet ; thence in a Northeasterly direction and following the arc of a curve to the left having a radius of 5559,65 feet and consuming an angle of 4° 31 ' 22" for an arc distance of 438.86 feet; thence North 5° 46 ' East for 214.00 feet ; thence angle right 90° for 10.00 feet to the point of beginning of this description. WHEREAS, the owners of more than two-thirds of the private property abutting upon the portion of street above described have duly filed their petition with the City Council of Everett, praying for the vacation of said portion of street, and 'WHEREAS, said City Council of the City of Everett did by resolution duly adopted, fix the 26th day of Seit. , 1952, at 10:00 o'clock A.M. of said day for the hearing and determination of said petition; and WHEREAS, due and legal notice of the time and place of said hearing and the determination of said petition has been given by the City Clerk in the manner required by law, and WHEREAS, at the time and place fixed for hearing no persons appeared or made objections to the vacating of the herein described portion of street and alley and no objections of any kind were made to the granting of said petition, and WHEREAS, it now appearing to the City Council that said petition should be granted and said Council does hereby determine to vacate the above described property, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the property in the City of Everett, County of Snohomish, State of Washington, described as follows, to- wit : Beginning at the Northwest corner of Lot 53, South High- way Addition to Everett; thence South 5° 46 ' West along the west line of Lots 45 to 53, inclusive, as platted, for 214.00 feet to a point of tangency of a curve to the right; thence in a Southwesterly direction and fol- lowing the arc of a curve to the right having a radius of 5569.65 feet and consuming an angle of 4° 30' 10" for an arc distance of 437.70 feet to an intersection with the North boundary of Cascade Terrace Addition produced Easterly; thence South 89° 10' 30" West along said North boundary for 10.14 feet ; thence in a Northeasterly
