ORDINANCE NO. 3396 <br /> AN ORDINANCE PROVIDING FOR THE VACATION OF THE FOLLOWING <br /> DESCRIBED PROPERTY IN THE CITY OF EVER±taT, COUNTY OF SNOHOMISH, <br /> STATE OF WASHINGTON, TO-WIT: <br /> Beginning at the Northwest corner of Lot 53, South <br /> Highway Addition to Everett; thence South 5° 46' Vest <br /> along the West line of Lots 45 to 53, inclusive, as <br /> platted, for 214.00 feet to a point of tangency of a <br /> curve to the right; thence in a Southwesterly direction <br /> and following the arc of a curve to the right having a <br /> radius of 5569.65 feet and consuming an angle of 4° 30' <br /> 10" for an arc distance of 437.70 feet to an inter- <br /> section with the North boundary of Cascade Terrace <br /> Addition produced Easterly; thence South 89° 10' 30" <br /> iyest along said north boundary for 10.14 feet ; thence <br /> in a Northeasterly direction and following the arc of <br /> a curve to the left having a radius of 5559,65 feet <br /> and consuming an angle of 4° 31 ' 22" for an arc <br /> distance of 438.86 feet; thence North 5° 46 ' East for <br /> 214.00 feet ; thence angle right 90° for 10.00 feet to <br /> the point of beginning of this description. <br /> WHEREAS, the owners of more than two-thirds of the private <br /> property abutting upon the portion of street above described have <br /> duly filed their petition with the City Council of Everett, praying <br /> for the vacation of said portion of street, and <br /> 'WHEREAS, said City Council of the City of Everett did by <br /> resolution duly adopted, fix the 26th day of Seit. , 1952, <br /> at 10:00 o'clock A.M. of said day for the hearing and determination <br /> of said petition; and <br /> WHEREAS, due and legal notice of the time and place of said <br /> hearing and the determination of said petition has been given by the <br /> City Clerk in the manner required by law, and <br /> WHEREAS, at the time and place fixed for hearing no persons <br /> appeared or made objections to the vacating of the herein described <br /> portion of street and alley and no objections of any kind were made <br /> to the granting of said petition, and <br /> WHEREAS, it now appearing to the City Council that said <br /> petition should be granted and said Council does hereby determine to <br /> vacate the above described property, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the property in the City of Everett, <br /> County of Snohomish, State of Washington, described as follows, to- <br /> wit : <br /> Beginning at the Northwest corner of Lot 53, South High- <br /> way Addition to Everett; thence South 5° 46 ' West along <br /> the west line of Lots 45 to 53, inclusive, as platted, <br /> for 214.00 feet to a point of tangency of a curve to <br /> the right; thence in a Southwesterly direction and fol- <br /> lowing the arc of a curve to the right having a radius <br /> of 5569.65 feet and consuming an angle of 4° 30' 10" for <br /> an arc distance of 437.70 feet to an intersection with <br /> the North boundary of Cascade Terrace Addition produced <br /> Easterly; thence South 89° 10' 30" West along said North <br /> boundary for 10.14 feet ; thence in a Northeasterly <br />
