ORDINANCE NO. 3389 <br /> AN ORDINANCE PROVIDING FOR THE VACATION OF THE FOLLOWING <br /> DESCRIBED PORTION OF STREE1' IN THE CITY OF EVERETT, COUNTY OF <br /> SNOHOMISH, STATE OF WASHINGTON, TO-WIT: <br /> Alley in Block 10, L'entral Park Addition to <br /> Everett, from Central Avenue to east bound- <br /> ary of alley between Central and Hoyt Avenue. <br /> WHEREAS, the owners of more than two-thirds of the pri- <br /> vate property abutting upon the portion of street and alley above <br /> described have duly filed their petition with the City Council of <br /> Everett praying for the vacation of said portion of street and alley; <br /> and <br /> WHEREAS, said City Council of the City of Everett did, <br /> by resolution duly adopted, fix the llth day of June, 1952, at <br /> 10:00 A.M. of said day for the hearing and determination of said <br /> petition; and <br /> WHEREAS, due and legal notice of the time and place of <br /> said hearing and the determination of said - etition has been given <br /> by the City Clerk in the manner required by law; and <br /> WHEREAS, at the time and place fixed for hearing <br /> objections to the vacating of the herein described portion of street <br /> and alley were heard and discussed; and <br /> WHEREAS, it now appears to the City Council that said <br /> petition should be granted and said Council does hereby determine <br /> to vacate the above described portion of street and alley, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the portion of street and alley in the <br /> City of Everett, County of Snohomish, State of Washington, described <br /> as follows, to-wit: <br /> Alley in Block 10, Central Park Addition to <br /> Everett, from Central Avenue to east bound- <br /> ary of alley between Central and Hoyt avenue <br /> be, and the same is hereby vacated and the title to the land in said <br /> portion of street and alley above described is hereby declared to <br /> vest in the abutting property owners as provided by law; except <br /> the City of Everett, retains an easement over, under and across said <br /> property vacated for the construction, repair and maintenance of <br /> public utilities and services, together with a right to construct <br /> sewer lines, water lines and other utility lines over, under and <br /> across said property under provisions of local improvement district <br /> laws of the state of '4iashington, assessing against the abutting <br /> property owners thereof the cost of said improvement in accordance <br /> with the laws of the State and the ordinances of said City. <br /> ./7/(2 /f ;4/ <br /> M a yz/o r <br /> Attest: <br /> ,; r <br /> sty Clerk s>I <br /> Ij <br /> Passed: September 16, 1952. <br /> Published: <br /> September 17, 1952 <br />
