- 4 ORDINANCE NO. 334.7• AN ORDINANCE providing for the improvement of the Alley west of College Avenue from 47th Street to the south line of the Plat of Vista Heights, by the construction of a sewer together with the necessary appurtenances and doing such other work as may be necessary in connection therewith, in accordance with a majority petition therefor; creating an assessment district; creating a local improvement district fund therefor, and provid- ing for the payment of said improvement by special assessment on the property in said district under the mode of payment by bonds. WHEREAS, there has been heretofore filed with the City Council of the City of Everett a majority petition of the pro- perty owners petitioning for said improvement and upon examin- ation thereof the said City Council has found the things set forth therein to be true; and WHEREAS, the said Petition has been referred to the Commissioner of Public Works to be examined by said Commissioner and the City Engineer, and the Commissioner of Public Works has filed with the City Council all data and information required by law; and WHEREAS, said Commissioner of Public Works has recommend- ed to the City Council that said improvement petitioned for to be made and it appearing to the City Council that said petition and improvement is proper in all manners, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the Alley west of College Avenue from 47th Street to the south line of the Plat of Vista Heights be improved by the construction of a sewer together with the necessary appurtenances and doing such other work as may be necessary in connection therewith, all according to the plans and specifications prepared under the direction of the City Engineer and which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of such improve- ment, including all necessary incidental expenses, shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto and the ordinances of the City of Everett. Section 3: That there is hereby established a local improvement district to be known as "Local Improvement District No. 622 ", which district shall include the following des- cribed property located in Everett, Snohomish County, Washington, to-wit Lots 1 to 4, inclusive, Slock 1, Plat of Vista Heights. Lots 1 to 4, inclusive, Block 2, Plat of Vista Heights. Beginning at the NYV corner of flat of Vista Heights; thence south along the westerly margin of Plat of ista Heights to the SW corner of said plat; thence westerly along the south line of Plat of Vista Heights extended westerly in its present platted direction for 129.08 feet to the easterly margin of Fowler Ave. extended south from 47th St. ; thence N along the said easterly margin of Fowler Ave. extended to the south margin of 47th St. ; thence easterly along the south margin of 47th St. for 128.98 feet to the point of beginning, less 48th St.
