• • 4 ORDINANCE NO. 3335 AN ORDINANCE providing for the improvement of Oakes Ave. from 10th St. to the Athletic Field by the construction of side- walks and integral curbs, installation of necessary drainage and including as a part of such work such grading or regrading as may be necessary and doing all other work as may be necessary in connection therewith, in accordance with a majority petition therefor; creating a local improvement district; creating a local improvement district fund therefor; and providing for the payment of said improvement by special assessment on the property in said district under the mode of payment by bonds. WHEREAS, there has been heretofore filed with the City Council of the City of Everett a majority petition of the pro- perty owners petitioning for said improvement, and upon examination thereof the said City Council has found the things set forth there in to be true, and WHEREAS, the said Petition has been referred to the Commissioner of Public Works to be examined by said Commissioner and the City Engineer, and the Commissioner of Public Works has filed with the City Council all data and information required by law, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That Oakes Ave. from 10th St. to the Athleti Field be improved by the construction of sidewalks and integral curbs, installation of necessary drainage and including as a part of such work such grading or regrading as may be necessary and doing all other work as may be necessary in connection therewith; all according to the plans and specifications prepared under the direction of the City Engineer and which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of such improve- ment including all necessary incidental expenses shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement except as provided by Chapter 1414, Session Laws of 1923 or acts amendatory thereto and the ordinances of the City of Everett. Section 3: That there is hereby established a local improvement district to be known as "Local Improvement District No. 593", which district shall include the following described property located in Everett, Snohomish County, Washington, to-wit: Lots 17, 18 and 19, Blk. 219, Bailey Add, to Everett; Lots 14, 15 and 16, Blk. 220, Bailey Add. to Everett; and the following unplatted property: Begin at the southeast corner of Lot 19, Blk. 219, Bailey Add. to Everett; th southerly along the west property line of Oakes Ave. for a distance of 416.39 ft. ; th angle left 90 degrees for 10 ft. ; th angle right 90 degrees for 255.34 ft to the north line of the SW4 SW4 NW4 of Sec. 17, Twp. 29 N. , Rge. 5 E.W.N[ ; th westerly along the said north line of the SW4 SW4 NW4j Sec. 17 for 130 ft. ; the northerly and parallel to the west property line of Oakes Ave. 672.26 ft. to the southwest corner of Lot 19, Blk 219, Bailey Add, to Everett; th easterly along the south line of said Lot 19 for 120 ft. to the point of beginning and (2) Begin at the southwest corner of Lot
