a . <br /> Section 4. The City Council of Grantor shall have the <br /> right to hear and determine what are just, fair and reasonable <br /> rates, fares and charges for the gas distribution service <br /> contemplated herein and to order that only reasonable charges <br /> shall be imposed, and to make effective such order by penalties <br /> and forfeitures. However, it is understood at present that <br /> the United States Government, the government of the State of <br /> Washington, and designated agencies operating under the author- <br /> ity of said governments have now exclusive jurisdiction to <br /> hear, determine, and make necessary orders concerning said <br /> rates, fares and charges and, therefore, during the period of <br /> time this condition exists, the foregoing power of the City <br /> Council of Grantor shall be held in abeyance and be without <br /> effect. In the event said City Council of Grantor again be- <br /> comes authorized to hear, determine and make applicable orders . <br /> concerning said rates, fares and charges, then the said fore- <br /> going power shall be revived and be effective. The granting <br /> of the franchise herein shall not confer any right upon the <br /> Grantee to include in the charge for its service hereunder any <br /> return upon the value of the franchise granted herein and <br /> Grantee agrees not to include such a return in its charges for <br /> services provided under this franchise. <br /> Section 5. The City Council of Grantor shall have the <br /> right under this franchise to require reasonable extensions <br /> of gas distribution and supply systems referred to herein. In <br /> addition, said City Council shall also have the right to make <br /> such rules and regulations as may be required to secure ade- <br /> quate and proper service under this franchise to itself and its <br /> inhabitants and to provide sufficient accomodations for the <br /> public generally. <br /> -4 <br />
