i ORDINANCE NO. 3311. AN ORDINANCE providing for the improvement of Highland Ave. from 20th St. to 22nd St. by the construction of a water main together with a fire hydrant and the necessary appurtenances and by doing all other work necessary to make a complete improvement, in accordance with a majority petition therefor; creating a local improvement dis- trict; creating a local improvement district fund therefor; and pro- viding for the payment of said improvement by special assessment on the property in said district under the mode of payment by bonds. WHEREAS, there has been heretofore filed with the City Council of the City of Everett a majority petition of the property owners petitioning for said improvement, and upon examination thereof the said City Council has found the things set forth therein to be true , and WHEREAS , the said Petition has been referred to the Com- missioner of Public Works to be examined by said Commissioner and the City Engineer, and the Commissioner of Public Works has filed with the City Council all data and information required by law, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That Highland Ave. from 20th St. to 22nd St. be improved by the construction of a water main together with a fire hydrant and the necessary appurtenances and by doing all other work necessary to make a complete improvement; all according to the plans and specifications prepared under the direction of the City Engineer and which plans and specifications are hereby adopted and approved. section 2: That the cost and expense of such improvement including all necessary incidental expenses shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement except as provided by Chapter 141 Session Laws of 1923 , or acts amendatory thereto and the ordinances of the City of Everett. Section 3 : That there is hereby established a local im- provement district to be known as "Local Improvement District No. 617 " , which district shall include the following described property located in Everett , Snohomish County, Washington, to-wit: Lots 1 to 16, inc. , Block 409, St. Nicholas Add. to Everett. Lots 17 to 32, inc. , Block 410, St. Nicholas Add. to Everett. Lots 17 to 20, inc. , Block 453 , St. Nicholas Add. to Everett. Lots 20 to 32, inc. , Block 453 , Garfield 2nd Add. to Everett. Lots 13 to 16, inc. , Block 454, St. Nicholas Add. to Everett. Lots 1 to 13 , inc. , Block 454, Garfield 2nd Add. to Everett. Section 4: A special fund is hereby created to be called "Local Improvement Fund No. 617 " , which shall consist in the aggregate of the several amounts assessed, levied and collected on the several lots, tracts and parcels of land in said local improvement
