ORDINANCE NO. 3306. AN ORDINANCE providing for the vacation of the following described portion of street in the City of Everett, County of Snohomish, State of Washington, to-wit: The alley in Plat of South Highway Add . to Everett from 50th St. to Wilmington Ave. described as follows: 1. Begin at the NE corner of Lot A So. Highway Add. to Everett; th S 5°46' west 540.25 ft.; th along the arc of a curve to the right having a radius of 6029.65 ft. and consuming $a angle of 1°33135" for 164.14 ft. to a point 5. ft. northerly of the northeast corner of Lot 14 as platted in South Highway Add. to Everett; th S 82043'54" E. 24. ft. to a point on the arc of a curve to the left, being the easterly margin of South Highway Add. to Everett; th following said curve, hay- ing a radius of 6,053 .65 ft. and consuming an angle of 1°34' for 165.53 ft., th N 5°46' E 525.61 ft. along the easterly margin of South High- way Add. to Everett to the so. line of Wilmington Ave. as platted and a point on the arc of a curve to the right; th. following said curve, having a radius of 659.43 ft. and consuming an angle of 2026'30" for 28.11 ft. to the point of beginning. Also Claremont Way in Plat of Claremont Heights from 50th St. to Wilmington Ave. described as follows: 2. Begin at the SW corner of Lot 21, Plat of Claremont Heights, th Northerly along the arc of a curve to the left having a radius of 6,089.65 ft. and consi m ng an angle of 1°34'37" for 167.60 ft., th N 5046' E 506.18 ft. to the south line of Wilmington Ave. as platted; th along the arc of a curve to the right having a radius of 659.43 ft. and consuming an angle of 3°33'25" for 40.91 ft. to the NW corner of Plat of Claremont Heights; th south 5°46' W 525.61 ft., th along the arc of a curve to the right having a radius of 6053.65 ft. and consum«- ing an angle of 1034' for 165.53 ft., th S 82°43'54" E for 36.0 ft. to the point of beginning. WHEREAS,the owners of more than two-thirds of the private property abutting upon the portion of street above described have duly filed their petition with the City Council of Everett, praying for the vacation of said portion of street; and WHEREAS, said City Council of the City of Everett did, by resolution duly adopted, fix the 20th day of October, 1950, at 10:00 o'clock A.M. of said day for the hearing and determination of said petition; and WHEREAS, due and legal notice of the time and place of said hearing and the determination of said petition has been given by the City Clerk of the manner j required by law; and WHEREAS, at the time and place fixed for hearing, no persons appeared 11 or made objections to the vacating of the herein described portion of street and no objections of any kind were made to the granting of said petition; and WHEREAS, it now appearing to the City Council that said petititon should 11 be granted and said Council does hereby determine to vacate the above described portion of street. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the portion of street in the City of Everett, County of Snohomish, State of Washington, described as follows, to-wit:
