ORDINANCE NO. 72O2, AN ORDINANCE providing for the improvement of DELAWARE AVENUE from 48th Street to a point approximately 425 ft. north of 48th Street by the construction of a sewer together with the necessary appurtenances and doing such other work as may be necessary in connection therewith, all in accordance with Re- solution No. 5473 of the City of Everett; creating a local improve- ment district; creating a local improvement district fund therefor, and providing for the payment of said improvement by special assessment on the property in said district under the mode of payment of bonds. WHEREAS, by Resolution No. 5473 of the City of Everett, the City Council has declared its intention to order the improve- ment as above outlined, and doing all work in connection there- with to make a complete improvement in accordance with the plans and specifications as prepared by the City Engineer of the City of Everett, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That Delaware Avenue from 48th Street to a point approximately 425 ft. north of 40th Street be improved by th- construction of a sewer, together with the necessary appurtenances and doing such other work as may be necessary in connection there- with, all according to the plans and specifications prepared under the direction of the City Engineer, and which plans and spec- ifications are hereby adopted and approved. Section 2: That the cost and expenses of such improve- ment, including all necessary incidental expenses, shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto and the ordinances of the City of Everett. Section 3: That there is hereby established a local improvement district to be known as "Local Improvement District No. ('16 " which district shall include the following described property located in Everett, Snohomish County, Washington, to-wit: Lots 25 to 41, inc. , Blk. 15, Central Park Add. to Everett. Lots 23 to 41, inc. , less the west 24 ft. of said lots deeded to the City for street pur- poses, Elk, 17, Central Park Add. to Everett. Section 4: A special fund is hereby created to be calle• Local Improvement Fund i'o. 616 , which shall consist in the aggregate of the several amounts assessed, levied, and collected on the several lots, tracts, and parcels of land in said local improvement district, and the proceeds of the sale of the bonds in said district for the purpose of defraying the costs and ex- penses of such improvement. Out of said fund shall be paid the bonds, the interest thereon, and the entire cost of such improve- ment.
