. <br /> ORDINANCE NO. 3288. <br /> An Ordinance amending Ordinance o. 3211 entitled: <br /> "An Ordinance relating to and regulating traffic, <br /> travel, transportation, and pedestrians and their in- <br /> cidents upon the streets, alleys, and public ways of <br /> Everett, a municipal corporation; prescribing the rules <br /> of road for vehicular, pedestrian and other traffic up- <br /> on such streets, alleys and public ways; prescribing <br /> the powers and duties of the officers and other Persons <br /> in relation thereto; defining offenses, providing penal- <br /> ties, adopting certain portions of the motor vehicle <br /> laws of the State of Washington and existing amendments <br /> thereto; and repealing ordinance numbers : 2318, 2734, <br /> 150,. 2348, 2 22, and 2612, all relating to traffic" <br /> by adding thereto Sections 187 and 188, and by amending sections <br /> 27 and 116. <br /> THE CITY OF EVE t ;TT DOES ORDAIN: <br /> Section 1 : That Section 27 of Ordinance No. 3211 be, and <br /> the same is hereby amended to read as follows : <br /> Section 27 : TRAFFIC CONTROL LIGHTS AND SIGNALS. <br /> Whenever, at any point, traffic is controlled by traffic control <br /> si-nals exhibiting the words "go", "caution", or "stop", or exhi- <br /> biting different colored lights successively, the following words <br /> or colors shall be used and shall indicate as follows : <br /> (1) Green alone or " o" : Vehicles facing such <br /> signal may proceed through the section of traffic control or turn <br /> right or left, unless a sign at such point indicates such turns <br /> are prohibited. Such vehicles shall yield the right-of-way to <br /> other vehicles and to pedestrians lawfully in the intersection con- <br /> trolled area at the time such signal is exhibited and shall permit <br /> them to proceed fro:,. the controlled area. It shall be unlawful <br /> for any pedestrian to enter or cross the roadway in that Portion <br /> of the controlled area through which vehicles are directed to pro— <br /> ceed by such exhibited green light or such word "go" . <br /> (2 ) Yellow alone or the word "caution" when shown <br /> following green or "go" signal : Vehicular traffic facing the sig- <br /> nal is thereby warned that the red or "stop" signal shall be exhi- <br /> bited immediately thereafter, and such vehicular traffic shall not <br /> enter or be crossing the intersection when the red or "stop" sig- <br /> nal is exhibited. Pedestrians facing such signal are thereby ad- <br /> vised that there is insufficient time to cross the roadway and <br /> shall wait for the next "go" signal for them to proceed. <br /> Section 2 :; That Section 116 at Ordinance No. 3211 be, <br /> and the same is hereby amended to read as follows : <br /> Section 116: It shall be unlawful and punishable as <br /> herein provided for any person who is under the influence of or <br /> affected by the use of intoxicating liquor or of any narcotic drug <br /> to drive or be in actual physical control of any vehicle upon the <br /> public streets or alleys of this city. <br /> In any criminal prosecution for a violation of the <br /> provisions of this section relating to driving a vehicle while un- <br /> der the influence of intoxicating liquor, the amount of alcohol in <br /> the defendant' s blood at the time alleged as shown by chemical <br /> analysis of the defendant' s blood, urine, breath, or other bodily <br /> substance shall give rise to the following presumptions : <br />
