ORDINANCE NO. 3285. An Ordinance providing for the improvement of the alley in Blocks Three ano your (3 & 4) , Plat of Vista Heights, being the alley between Alger kL venue and College avenue from 47th Street to the south line of Plat of Vista sleights, by the construction of a sewer, together with the necessary appurtenances and such other work as may be necessary in connection therewith, in accordance with a majority petition therefor ; creating an assessment dis- trict; creating a local improvement district fund therefor; and providing for the payment of said improvement by special assess- ment on the property in saia district under the mode of payment b bonds. WHEREAS, there nas been heretofore filed with the City Council of the City of Everett a majority petition of the proper- ty owners petitioning for said improvement, and upon examination thereof the said city Council has found the things set forth therein to be true; and WHEREAS, the said Petition has been referred to the Com missioner of Public Works to be examined by said commissioner and the City Engineer, ana the commissioner of Public Works has filed with the City Council all data and information required by law; and WHEREAS, said Commissioner of Public uvorks has recom- mended to the City Council that said improvement petitioned for be made, and it appearing to the City Council that the public health, convenience, and necessity require that such improvement be made. NOW, T'HEREFORE, THE CITY CF EVERETT DOES ORDAIN: Section 1: That the alley in Blocks Three and Four (3 & 4) , Plat of Vista Heights, being the alley between Alger Ave nue and College Avenue from 47th Street to the south line of Plat of Vista Heights, be improved by the construction of a sewer, to- gether with the necessary appurtenances and such other work as may be necessary in connection therewith, all according to the plans and specifications prepared under the direction of the City Engineer and which plans and specifications are hereby adopted and approved. Section 2 : That the cost and expense of such improve- ment including all necessary incidental expense shall be borne by and assessed against the property included in the assessment dis- trict herein created in accoruance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto and the or- dinances of the City of Everett. Section 3; That there is hereby established a local improvement district to be known as "Local Improvement District f' No. 611 , which district shall include the following describe' property, located in Everett, Snohomish County, Washington, to-wi Lots 1 to 8, inc.
