<br /> ORDINANCE NO. 3282,
<br /> An Ordinance providing for the improvement of the alley
<br /> in Block Two (2) , College hill Addition, being the alley between
<br /> Fowler Avenue and College Avenue from 46th Street to 47th Street
<br /> by the construction of a sewer, together with necessary appurte-
<br /> nances, providing for the necessary surface drainage and doing
<br /> such other work as may be necessary in connection therewith, in
<br /> accordance with a majority petition therefor, creating an assess-
<br /> ment district, creating a local improvement district fund there-
<br /> for , and providing for the payment of said improvement by special
<br /> assessments on the property in said district under the mode of
<br /> payment by bonds.
<br /> 4 WHEREAS, there has been heretofore filed with the City
<br /> Council of the City of mverett a majority petition of the property
<br /> owners petitioning for said improvement; and, upon examination
<br /> thereof, the said City Council has found the facts set forth
<br /> therein to be true, and
<br /> 1 HEM EAS, said petition has been referred to the Commis-
<br /> sioner of Public Works to be examined by said Commissioner, and
<br /> the City Engineer and Commissioner of Public War ks has filed With
<br /> the City Council all data and information required by law, includ-
<br /> ing maps, plans, and specifications, and
<br /> WHEREAS, the cost of the improvement may exceed the
<br /> true value of the property, less improvements and less outstanding
<br /> unpaid local improvement assessments, and
<br /> WHEREAS, the City Council has, by unanimous vote, held
<br /> the improvement to be necessary for the public health and benefit
<br /> and has ordered the same,
<br /> NOma, THEREFORE, THE CITY OF EVERETT DOES ORDAIN:
<br /> Section 1: That the City Council of the City of
<br /> Everett does, by unanimous vote, find the improvement necessary
<br /> for the public health and benefit and orders the same.
<br /> Section 2: That the alley in Block Two (2) , College
<br /> Hill Addition, being the alley between Fowler Avenue and College
<br /> Avenue from 46th Street to 47th Street shall be improved by the
<br /> construction of a sewer, together with necessary appurtenances,
<br /> and by necessary surface drainage and such other work as may be
<br /> necessary in connection therewith, all in accordance with maps,
<br /> plans, and specifications prepared by' the direction of the City
<br /> Engineer, which maps, plans, and specifications are hereby ap-
<br /> proved and adopted.
<br /> Section 3: That the costs and expenses of such improve-
<br /> ment, including all necessary expenses, shall be borne by and as-
<br /> sessed against the property included in the assessment district
<br /> herein created in accordance with the law. The City of Everett
<br /> shall not be liable, in any manner, for any portion of the costs
<br /> and expenses of such improvement, except as provided by Chapter
<br /> 141, Session Laws of 1923 of the State of +ashington, or acts
<br /> amendatory thereto, and the Ordinances of the City of mverett.
