ORDINANCE NO. 3278. An Ordinance proviaing for the improvement of Hoyt Avenu: from 50 feet north of 10th Street to the north line of heady Lana Company' s 2nd Addition oy the construction of a concrete sidewalk on the east side of the street only; also Hoyt Avenue from the north line of Heady Land Company' s 2nd Addition to Alverson Boule- vard by the construction of a concrete sidewalk and concrete curbs and gutters on both sides of the street and including as a part of said work the installation of necessary drainage, such grading or regrading as may be necessary and doing such other work as may be necessary in connection therewith, in accordance with a majority petition therefor; creating an assessment district; creating a local improvement district fund therefor, and providing for the payment of said improvement by special assessment on the property in said district under the mode of payment by bonds. WHEREAS, there has been heretofore filed with the City Council of the City of uverett, a majority petition of the propert owners petitioning for said improvement and upon examination there of the said City Council has found the things set forth therein to be true; and 4HEREAS, the sat a Petition has been referred to the Com- missioner of Public Works to be examined by said Commissioner and the City Engineer, ana the Commissioner of rublic viorks has filed with the City Council all data and information required by law; and WHEREAS, said Commissioner of Public Works has recommend ed to the City Council that said improvement petitioned for to be made and it appearing to the City council that said petition and improvement is proper in all manners, NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That Hoyt Avenue from 50 feet north of 10th Street to the north line of Ready Land Company' s 2nd Addition be improved by the construction of a concrete sic..ewalk on the 'exist side of the street only; also Hoyt Avenue from the north line of Ready Land company' s 2nd ,Addition to Alverson Boulevard be im- proved by the construction of a concrete sidewalk and concrete curbs and gutters on both sides of the street and including as a part of said work the installation of necessary drainage, such grading or regrading as may be necessary and doing such other work as may be necessary in connection therewith, all according to the plans and specifications prepared under the direction of the City Engineer, and which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of such improvemen , including all necessary incidental expense, shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and ex- penses of such improvement except as provided by Chapter 141, Session '-Jaws of 1923, or acts amendatory thereto anu the ordinance: of the city of Everett.
