C. Thc Owner and the City desire to enter into this Agreement to <br /> clarify their respective roles regazding the Pao6water Valve. <br /> AGREEMENT <br /> For good and valuable consideration,the receipt and sufficiency of which are <br /> hereby acknowiedged,the City and Owner agree as follows: <br /> A. Mnintenance uf Backwater Valve. <br /> The Owner is exclusively responsible for the maintenance of the Baakwater <br /> Valve. Future owners of the Properry assuma the respons�bility for maintaining the <br /> Backwater Valve when they take ownership of the Property. The Owner,on behalf <br /> of itself and on behalf of all firture owners of the Property,releases the City&om all <br /> claims and liabilities arising&om or relating to any failure to maintain t1�e <br /> Backwater Valve by the Owner or by any future owner of the Pmperty. Upon the <br /> Owner s request,the City will provide the Owner with educational brochures and <br /> uther materials regazding Back� iter Valve maintenance. <br /> B. Citv Rinht� to YnsDect• <br /> The Owner hereby grants perm�ssion for the City to enter upon the <br /> Property&om time to time to iaspext the Backwater Valve and the Pmperry's <br /> other plumbing and drainage systems. 'fhis permission remains in effect for as <br /> long as the Backwater Valve remains installed.
