side sewer because the side sewer was full, causing the gutters/downspouts to overflow and sending water <br /> toward your basement." <br /> I called Brian from Public Works and asked if he could shed some light on the claim denial and if he thought <br /> the flooding would have still occurred, had we disconnected the gutters. He stated"from the people I've spoken <br /> with who saw the downpour, they said the rain was coming down so hard and fast that it barely made it into the <br /> gutters". <br /> After all this, I have a few arguments to make. <br /> 1.) 1. It was reconfirmed multiple times that things would be taken care of, to document everything, and get <br /> estimates for the repairs and to start repairing because our claim would be paid out shortly. There is no reason <br /> for the delay on the denial paperwork to have taken over 3 weeks to be sent to us when the decision was made <br /> much earlier. Multiple media outlets were broadcasting that claims would be paid out, which was not only <br /> misleading to us but also a lie. <br /> 2.) 2. Proper maintenance had been performed on the backflow valve as was verbally stated to us.upon <br /> installation. Lines for the sump pump secondary to flooding were disassembled, inspected for clogging (with <br /> none found), sump pump was tested and worked with proper float placement, and lines were reassembled. Due <br /> to the elimination of the sump pump being an issue, it brings us back to the backflow valve. <br /> 3.) 3. The amount of rain which had collected in the basement was nearly 2800 gallons of water which also <br /> included sediment in it and would have been impossible for that amount to have collected from the downspouts <br /> or gutters. The proper calculation for rain water collection per inch is 5.61 gallons per square yard. When you <br /> do the math for our square yardage of roof area,there is no way for that amount of water to be collected into the <br /> gutter system. <br /> In conclusion,the evidence we have found leads to a malfunction in the backwater valve installed. I understand <br /> many homes and businesses were affected by the flood and that decisions take time. I also know that some <br /> people who are offered an inch take a mile and will milk a situation for all it is worth. My husband, brother-in- <br /> law and I don't feel we are asking for anything outrageous,we simply want fixed what was damaged by a faulty <br /> city infrastructure. I highly encourage and would greatly appreciate any questions you may have in regards to <br /> our situation.
