5. Hearing Date,Time & Location Respondent is scheduled to appear before the Violations Hearing Examiner on: HEARING DATE: Thursday, March 7, 2013 at 1:00 pm. LOCATION: City of Everett Violations Hearing Room Wall Street Building, Suite #8-C 2930 Wetmore Avenue Everett, Washington 98201 6. Hearing examiner Following the hearing, the Violations Hearing Examiner may issue an order against the Respondent, even if he/she does not attend the hearing. The Hearing Examiners'Order may: A. Require that the violations be corrected by a specific date; B. Impose a monetary penalty in accordance with Chapter 1.20 EMC; C. Authorize the City to enter the property, correct the violations and to assess the costs of the corrections, as permitted by law. A copy of the City's Proposed Hearing Examiner Order will be available to pick up at the Police Department Records Unit counter located on the first floor at 3002 Wetmore Avenue after 2pm, on the day before the hearing. VIOLATION OF A HEARING EXAMINERS ORDER IS A CRIMINAL MISDEMEANER 7. Stipulated Order If the Respondent completes the minimum corrective action described in this citation, the Respondent is eligible to enter into a Stipulated Order with the City. A"Stipulated Order" means that the City will not take further action against the Respondent for the violations described in this citation as long as the Respondent does not commit or allow any further violations enforced under Chapter 1.20 EMC for two years following the date of the Stipulated Order. Notwithstanding paragraph 6, if the Respondent enters into a Stipulated Order with the City, the Respondent is no longer required to appear at the Hearing on the date set forth in Paragraph 5.
