Zlab <br /> 17832 40th Avenue NE <br /> Lake Forest Park, WA 98155 <br /> NOTICE OF CONDEMNATION <br /> A recent inspection of your property at 2621 Rockefeller Avenue Unit C revealed an <br /> unlawful basement apartment that unsafe and had unhealthy interior conditions in violation of <br /> the International Property Maintenance Code (IPMC) as adopted by the City of Everett. Records <br /> of the Snohomish County Assessor show that you are the legal owner of 2621 Rockefeller <br /> Avenue. <br /> The additional basement dwelling unit was created without required City of Everett approvals <br /> and permits and is therefore an Unlawful Structure as defined by IPMC 108.1. in violation of <br /> IPMC 106.1 which reads; <br /> IPMC 108.1.4 Unlawful Structure. An unlawful structure is one found in whole <br /> or in part to be occupied by more persons than permitted under this code, or was <br /> erected, altered or occupied contrary to law. <br /> IMPC 106.1 Unlawful acts. It shall be unlawful for a person, firm or corporation <br /> to be in conflict with or in violation of any provisions of this code. <br /> Due to the unsafe and unhealthy conditions observed within the basement unit at 2621 <br /> Rockefeller Avenue, Unit C is deemed unfit for human occupancy pursuant to Section <br /> 108.1.3 of the IPMC. <br /> Pursuant Section 108 of the IPMC the City will condemn 2621 Rockefeller Avenue #C on <br /> March 24, 2017. <br /> The unit must be vacated no later than March 27, 2017. Any further occupancy of the unit <br /> after March 27, 2017 may result in criminal charges being filed against all of the persons <br /> responsible. Any legal tenants affected by the condemnation must be re-located in accordance <br /> with the provisions of the Washington State Landlord-Tenant Act, RCW 59.18. <br /> Everett Police Department,Code Enforcement Unit•3002 Wetmore Ave•Everett,WA 98201 •425-257-8560 <br />
