7.5.1.12 Other costs reasonably and properly incurred in the performance of the Work to <br /> the extent approved in writing by Owner. <br /> 7.5.1.13 Site security, temporary fencing, signage and similar security and safety <br /> measures for active construction areas. <br /> 7.5.1.14 Costs for agreed-upon Allowance Items as described and defined in Section 7.7 <br /> herein. <br /> 7.5.2 Non-Reimbursable Costs. The following shall be excluded from the Cost of the Phase 2 <br /> Work: <br /> 7.5.2.1 Compensation for Design-Builder's personnel stationed at Design-Builder's <br /> principal or branch offices, except as provided for in connection with Sections 7.5.1.1, 7.5.1.2, and 7.5.1.3, <br /> costs associated with Construction General Conditions Work, items intended to be covered by the Design- <br /> Build Fee, and Pass-Through Costs. <br /> 7.5.2.2 Expenses of the Design-Builder's principal office and offices other than the site <br /> office. <br /> 7.5.2.3 The cost of Design-Builder's capital used in the performance of the Work. <br /> 7.5.2.4 If the parties have agreed on a GMP, costs that would cause the GMP, as <br /> adjusted in accordance with the Contract Documents, to be exceeded. <br /> 7.5.2.5 Any bonuses or incentive pay that is the obligation of Design-Builder to pay. <br /> 7.5.2.6 Rental costs of administrative equipment. <br /> 7.5.2.7 Costs due to the negligence or failure of the Design-Builder, Subcontractors and <br /> suppliers or anyone directly or indirectly employed by any of them, or for whose acts any of them may be <br /> liable, to fulfill a specific responsibility of the Design-Build Documents. <br /> 7.5.2.8 Overhead and general expenses, except as may be expressly included in <br /> Section 7.4. <br /> 7.5.2.9 Costs, other than costs included in Change Orders approved by the Owner, that <br /> would cause the Guaranteed Maximum Price to be exceeded. <br /> 7.5.2.10 Penalties, extensions, fines, and reinspection fees imposed by governmental <br /> entities to the extent caused by the Design-Builder or a Subcontractor of any tier. <br /> 7.5.2.11 Safety costs expressed as a percentage or as any other calculated expression. <br /> 7.5.2.12 Legal, consultant, or claims-related expenses except as specifically provided in <br /> Section 7.5.1. <br /> 7.5.2.13 Accounting in the Design-Builder's main or home office. <br /> 7.5.2.14 Warehousing in Design-Builder's facility, except as approved under Section <br /> 7.5.1. <br /> 7.5.2.15 Daily commuting to the jobsite. <br /> 7.5.2.16 Business license(s). <br /> PROGRESSIVE DESIGN-BUILD CONTRACT,Page 12 <br />
