a. Include a clear explanation of how the event or conditions specifically impacted the <br /> critical path and overall construction schedule and the amount of the adjustment <br /> in Contract Time requested. <br /> b. Demonstrate that the delay could not have been avoided by re-sequencing of the <br /> Work or other reasonable alternatives. <br /> c. Be limited to the change in the critical path of a construction schedule, and any <br /> updates, attributable to the event or conditions which caused the request for <br /> adjustment. <br /> 8.3 In addition to Design-Builder's right to a time extension for those events set forth in Section 8.2.1 <br /> above, Design-Builder may also be entitled to an appropriate adjustment of the GMP; except that <br /> the GMP will not be adjusted for Force Majeure Events. <br /> Article 9 <br /> Changes to the GMP and Contract Time <br /> 9.1 Authorized Changes in the Work <br /> 9.1.1 General. After execution of the Contract, Changes in the Work are effective solely by <br /> Change Order or Work Change Directive. <br /> 9.1.2 Change Order. A Change Order is a written instrument issued after execution of the <br /> Contract signed by Owner and Design-Builder, stating their agreement upon all of the following: <br /> 9.1.2.1 The scope of the change in the Work; <br /> 9.1.2.2 The amount of the adjustment to the GMP, if any; and <br /> 9.1.2.3 The extent of the adjustment to the Contract Time(s), if any. <br /> A Change Order shall constitute full payment and final settlement of all Claims for Contract Time <br /> adjustment and for direct, indirect, and consequential costs, including costs of delays, <br /> inconvenience, disruption of schedule, or loss of efficiency or productivity, related to any Work <br /> either recovered or affected by the Change Order, or related to the events giving rise to the request <br /> for equitable adjustment <br /> 9.1.3 Design-Builder Request for Change Order. Change Order requests may be initiated <br /> by Design-Builder in accordance with this subsection 9.1.3. <br /> 9.1.3.1 If Design-Builder believes that it is entitled to relief for any event or condition arising <br /> out of or related to the Work or Project, Design-Builder shall provide to Owner a <br /> written Notice of Intent to Submit a Request for Change Order no later than seven <br /> days after the event or condition giving rise to the claim for relief. <br /> 9.1.3.2 Unless the Owner's Representative issues written notice authorizing Design- <br /> Builder additional time to submit the Request for Change Order, Design-Builder <br /> shall provide a written Request for Change Order to the Owner's Representative <br /> no later than 21 days after delivery of the Notice of Intent to Submit a Request for <br /> Change Order. The Request for Change Order must include (a) specific dollar <br /> amount of the requested change to GMP, covering all costs associated with the <br /> GENERAL CONDITIONS OF PROGRESSIVE DESIGN-BUILD CONTRACT,Page 20 <br />
