II. The Property has (or will soon have) a backwater valve in the sewer line serving the Propc�y (the "Backwater Valve"). C. The Owner and the City desire to enter into this Agreement to clarify tl�eir respective roles regarding the Back�vater Valve. AGREEMENT For good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the City and Owner agree as follows: A. Maintenance of Backwater Valve. T'he Owner is exclusively responsible for the maintenance of the B�ckwater Valve. Future owners of the Property assume the responsibility for maintaining the Sackwater Valve witen they take ownersl�ip of the Property. The Owner, on behalf oi itself nnd on behalf of all fuhtre owners of the Property, releases the City from all claims and liabilities arising from or relating to any failure to maintain the Backwater Valve by the Owner or by any future owner of the Property. Upon the O�vner's request, the City will provide the Owner with educational brochures and other materials regazding Backwater Valve maintenance. B. Citv Riaht to Inspect. The OHmer hereby grants permission for the City to enter upon the Property from time to time to inspect the Backwater Valve and the Property's other plumbing and drainage systems. This pertnission remnins in effect for as long as the Backwater Valve remains installed. The City may, but has no obligation to, perform maintenance on the Backwater Valve during these inspections. C. Other. The Owner consents to recording of this Agreement. This Agreement runs with the land and binds all of the Owner's successors-in-interest. This Agreement and the Inspection and Backwater Valve Agreement signed by the Owner and the City contain the entire agreement between the City and the Owner relating to the Backwater Valve. No amendment or termination of this Agreement is effective unless it is in writing and signed by the Owner and by the Mayor of tlie City. �c: ��.,u • �� 1
