B. The Property has (or will soon have) a backwater valve in the sewer line serving the Property (the "Backwater Valve"). C. The Owner and the City desire to enter into this Agreement to clarify their respective roles regarding the Backwater Valve. AGREEMENT For g�od and valuable consideration. the receipt and sufficiency of which are hereby acknowledged, the City and Owner agree as follows: A. M1iaintenance of Backwater Valve. The O�vner is exclusively responsible for the maintenance of the Backwater Valve. Future owners of the Property assume the responsibility for maintaining the Backwater Valve when they take o�vnership of the Property. The Owner, on behalf of itself and on behalf of all future owners of tlie Property, releases the City from all claims and liabilities arising from or relating to anv failure to maintain the Backwater Valve l�y the O�vner or by any future owner of tUe Property. Upon lhe Owner's request, the City will provide 'he Owner with educational brochures and other materials regarding Backwater Val�•e maintenance. B. Citv Rieht to Irtsnect. The Owner hereby grants perniission for the City to enter upon the Property from time to time to inspect the Backwater Valve and the Property's other plumbing and drainage systems. This permission remains in effect for as long as the Backwater Valve remains installed. The City may, but has no obligation to, perfom� maintenance on the Backwater Valve during these inspections. C. Other. The Owner consents to recording of this Agreement. Tlvs Agreement runs with the land and binds all of the Owner's successors-in-interest. This Agreement and the Inspection and Back�vater Valve Agreement signed by the Owner and the City contain the entire agreement between the City and the Owner relating to the Backwater Valve. No amendment or termination of this .4greement is effective unless it is in �vriting and signed by the O�vner ar,d by the Mayor of the City.
