B. The Properiy has (or will soon have) a backwater valve in the sewer line serving the Property (the "Backwaler Vnlve"). C. The Owner and the City desire to entcr inro this Agreement to clarify their respective roles tegazding the Backwater Valve. AGREEMENT For good and valuable consideration, the receipt and sufficiency of which are hereby acknuwledged, the City and Owner agree as follows: A. Maintenance of Backwater Valve. The Owner is exclusively n;sponsible for the maintenance of ihe Backwater Valve. Future owners of lhe Property assume ilte responsibility for maintaining the I3ackwater Valve when they take ownership of the Property. The Owner, on ttehalf of itself and on behalf of all future owners of the Property, releases the City from all claims and liabilities azising from or relating to any failure to maintain the Backwater Valve by the Owner or by any future owner of the Properry. Upon the Owner's request, the City will provide the Owner with educational brochures and other :naterials regarding Backwater Valve maintenance. B. Citv Riaht to Insnect. The Owner hereby grants permission for the City to enter upon the Property from time lo time to inspect tUe Backwater Valve and the Property's other plumbing and drainage systems. This permission remains in effect for as long as the Backwater Valve remains installed. The City may, but has no obligation to, perform maintenance on the Backwater Valve during these inspections. C. Othcr. The Owner wnsents to recording of this Agreemenl. This Agreement tutts with thc land and binds all of the Owner's successors-in-interest. This Agreement and the Inspection and Backwater Vaive Agreement signed by the Owner and the City contain the entire agreement between the City and the Owner relating to the Backwater Valve. No amendment or tern»nation of tliis Agreement is effective unless it is in �vriting and signed by the Owner and by the Mayor of the City.
