B, The Property has (or �vill soon have) a backwater valve in the sewer line serving the Property (the "Backwaler Valve"). C. The Owner and the City desire to enter into this AUreement to clarify their respective roles regazding the Backwater Valve. AGREEMENT For good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, the City and Owner agree as follows: A. Maintenance of Backwater Valve. The Owner is exclueively responsible for the maintenance of the Backwater Valve. Future owners of the Property assume the responsibility for maintaining the Backwater Valve when they take ownership of the Property. The Owner, on behalf of itself and on behalf of all future owners of the Property, releases the City from all claims and liabilities arising from or relating to any failure to maintain the Backwater Valve by the Owner or by any future owner of the Property. Upon the Owner's request, the City will provide the Owner with educational brochures and otl�er materials regarding Back�vater Valve maintenance. B. Citv Rieht to Insoect. The Owner hereby grants permission for the City to enter upon the Property from time to time to inspect the Backwater Valve and the Property's other plumbing and drainage systems. This permission remains in effect for as long as the Backwater Valve remains installed. The City may, but has no obligation to, perform maintenance on the Buckwater Valve during these inspections. C. Othcr. The Owner consents to recording of ihis Agreement. This Agreement nu�s witU the land and binds all of the Owner's successors-in-interest. This Agreement and tl;e Inspection and Backwater Valve Agreement signed by the Owner and the City contain the entire agreement bet�veen the City and the O�vner relating to the Backwater Valve. No amendment or terniination of this Agreement is effective unless it is in writing u�d signed by the Owner and by the Mayor of the City.
