} <br /> J . r <br /> • <br /> ORDINANCE NO. 322G . <br /> AN ORDINANCE amending Sections 5 and 8 of Ordinance <br /> 3115 of the City of Everett, entitled as follows: <br /> "An Ordinance declaring certain buildings and <br /> structures public nuisances, PROVIDING FOR the <br /> abatement thereof and demolition thereof, <br /> authorizing certain city officials and employees <br /> to examine every such building or structure and <br /> authorizing the City Council to declare such <br /> buildings or structures to be public nuisances and <br /> unsafe for occupancy, providing for notice thereof, <br /> providing for an appeal thereof, providing for an appeal <br /> board, providing for punishment therefor, and <br /> declaring an emergency. " <br /> and declaring an emergency. <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That Section 5 of Ordinance 3115 of the <br /> City of Everett, entitled as above set forth, be, and the same is <br /> hereby amended to read as follows: <br /> Section 5: In case the owner shall fail, neglect <br /> or refuse to comply with the notice to repair, <br /> rehabilitate, or to demolish and remove said building <br /> or structure or portion thereof, the City Council <br /> may order the owner of the building prosecuted as <br /> a violator of the provisions of this ordinance, and <br /> the City Council may take such action as it deems <br /> necessary to abate such nuisance, including the <br /> destruction and removal of such nuisance. <br /> Section 2: That Section 8 of Ordinance 3115 of the <br /> City of Everett, entitled as above set forth, be, and the same is <br /> hereby amended to read as follows: <br /> Section 8: A board of examiners and appeals consist- <br /> ing of five (5) members who are qualified by experience <br /> and training to pass upon matters pertaining to <br /> building safety and construction shall be appointed <br /> by the Mayor of the City of Everett and shall hold <br /> office at his pleasure. The board shall adopt such <br /> reasonable rules and regulations for conducting its <br /> investigations as it shall deem proper and shall render <br /> all decisions and findings in writing to the City <br /> Council with a duplicate copy to the appellant. <br /> Their decision shall be rendered within ten days of <br /> date of appeal and their decision and the decision of <br /> the City Council shall be final and conclusive unless <br /> an appeal shall be filed with the Superior Court, <br /> Snohomish County, Washington to review the decision <br /> of the findings of the City Council and Board of <br /> Examiners, such appeal to be filed within ten days <br /> of the service of a copy of the findings of the Board. <br /> of Examiners upon the appellant. <br /> -1- <br />
