DocuSign Envelope ID:4FDC9314-82D3-4B1A-AB61-B800375B0441 <br /> LICENSE TO USE CITY PROPERTY <br /> THIS LICENSE AGREEMENT (the "License"), between the City of Everett, a municipal <br /> corporation, as Grantor (the "City) and Snohomish County Public Transportation Benefit <br /> Area aka Community Transit, a municipal corporation, as the Grantee ("Community <br /> Transit"), relates to the city owned parking lot located at the northeast corner of 26th <br /> Street and W. Marine View Drive, Everett, WA (the "Property"). <br /> RECITALS <br /> A. Community Transit desires to utilize the property for parking of <br /> Community Transit fleet vehicles. <br /> B. The City is willing to grant Community Transit authority to use the City's <br /> property upon certain terms and conditions. <br /> AGREEMENT <br /> In consideration of good and valuable consideration,the receipt and sufficiency of which <br /> is hereby expressly acknowledged, the City licenses Community Transit to use the <br /> Property upon the following terms and conditions: <br /> Section 1. LICENSED PROPERTY. The specific area of property owned by the City, and <br /> subject to this License, is legally described as LOTS 5 THRU 16, BLOCK 558, PLAT OF <br /> EVERETT DIV. G, as filed for record under Vol. 4, Page 41, records of Snohomish County, <br /> State of Washington. <br /> Section 2. TERM. This License shall be effective June 1, 2022 and shall expire at <br /> midnight on December 31, 2022, unless terminated earlier per Section 7, below. Any <br /> tenancy after the initial term shall be on a month to month basis. <br /> Section 3. MONTHLY CONSIDERATION. Community Transit shall pay $3,220 per <br /> month, due on the first day of each month during the term of this License. <br /> Section 4. AUTHORIZED USE. Community Transit may only use the property for the <br /> purpose of parking of fleet vehicles. <br /> Section 5. INDEMNIFICATION. Community Transit hereby agrees to defend, <br /> indemnify and hold the City harmless from any and all Claims for injury to people or <br /> damage to property arising out of or related to this License. This defense and <br /> indemnification obligation shall survive any termination, revocation or expiration of this <br /> page 1 <br />
