ORDINANCE NO. 3207 AN ORDINANCE providing for the improvement of 32nd Street from Colby Avenue to Hoyt Avenut by the construction of a Portland cement concrete pavement with integral curbs, the con- struction or reconstruction of all sewers, water mains and hydrants with necessary appurtenances, the construction or reconstruction of concrete sidewalks where necessary by providing the necessary surface drainage and doing such other work as may be necessary to make a complete improvement; in accordance with a majority petition therefor ; creating an assessment district; creating a local improve- ment district fund therefor; and providing for the payment of said improvement by special assessment on the property in said district under the mode of payment by bonds. WHEREAS, there has been heretofore filed with the City Council of the City of Everett a majority petition of the property owners petitioning for said improvement, and upon examination thereo . the said City Council has found the things set forth therein to be true; and WHEREAS, the said Petition has been referred to the Commissioner of Public Works to be examined by said Commissioner and the City Engineer, and the Commissioner of Public Works has filed E with the City Council all data and information required by law; and F WHEREAS, said Commissioner of Public Works has recommended to the City Council that said improvement petitioned for be made, and it appearing to the City Council that the public health, con- venience and necessity require that such improvement be made. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That 32nd Street from Colby Avenue to Hoyt Avenue be improved by the construction of a Portland cement concrete pavement with integral curbs, the construction or reconstruction of all sewers, water mains and hydrants with necessary appurtenances, the construction or reconstruction of concrete sidewalks where necessary by providing the necessary surface drainage and doing such other work as may be necessary to make a complete improvement, all according to the plans and specifications prepared under the direction of the City Engineer, and which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of such improvement including all necessary incidental expense shall be borne by and assessed against the propertyind.ided in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement except as provided by Chapter 141 Session Laws of 1923, or acts amendatory thereto and the ordinances of the City of Everett. Section 3 That there is hereby established a local improvement district to be known as "Local Improvement District No. b07 ", which district shall include the following described property located in Everett, Snohomish County, Washington, to-wit: -1-
