I <br /> ORDINANCE, NO. s . <br /> 3203. <br /> AN ORDINANCE providing for the improvement of McDougall <br /> Avenue from Everett Avenue to 26th Street by grading to proper <br /> grade, construction of a Portland cement concrete pavement, concrete <br /> curbs, installation of necessary drainage and doing all work necessary <br /> ? to make a complete improvement; in accordance with a petition <br /> presented by the owners of seventy-five (75 0) per cent of the lineal <br /> • frontage upon the improvement and seventy-five (750) per cent of <br /> the owners of the area of the property within the improvement, <br /> requesting that the limitation of the assessment be raised to twice <br /> the assessed valuation to finance the improvement, creating a <br /> local improvement district fund therefor, and providing for the <br /> payment of said improvement by special assessment on the property <br /> in p-aid district under the mode of payment by bonds. <br /> ss <br /> WHEREAS, there has heretofore been filed with the City <br /> , Council of Everett a petition for a local improvement as hereinafter <br /> p set forth, signed by seventy-five (75o) per cent of the owners of <br /> the area within the district, and by owners of seventy-five (75%) <br /> per cent of the lineal frontage upon said improvement, requesting <br /> that such limitation of assessment be raised to twice the assessed <br /> • valuation, and <br /> WHEREAS, the said petition has been referred to the <br /> , Commissioner of Public works to be examined by said Commissioner <br /> and City Engineer, and the Commissioner of Public works has filed <br /> with the City Council all data and information required by law, and <br /> WHEREAS, said Commissioner of Public works has recommended <br /> j4• to the City Council that said improvement petitioned for be made, <br /> and it appearing to the City Council that the public health, <br /> conveniences and necessity requires that such improvement be made, <br /> • and the City Council having unanimously voted for the construction <br /> of said improvement as a public necessity. <br /> NOW, THEREFORE, ThE CITY CJIP EVERE:TT DOES ORDAIN: <br /> Section 1: That McDougall Avenue from Lverett Avenue <br /> jto 26th Street be improved by grading to proper grade, construction <br /> of a Portland cement concrete pavement, concrete curbs, installation <br /> of necessary drainage and doing all work necessary to make a <br /> complete improvement, all according to the plans and specifications <br /> prepared under the direction of the City Engineer, and which plans <br /> and specifications are hereby adopted and approved. <br /> Section 2• That the cost and expense of such improvement, <br /> including all necessary incidental expense, shall be borne by and <br /> assessed against the property included in the assessment district <br /> herein created in accordance with law. ihe City of Everett shall <br /> not be liable in any manner for any portion of the costs and expenses <br /> of such improvement except as provided by Chapter 141 Session Laws <br /> of 1923, or acts amendatory thereto and the ordinances of the City <br /> of Everett. <br /> -1- <br />
