I ORDINANCE, NO. s . 3203. AN ORDINANCE providing for the improvement of McDougall Avenue from Everett Avenue to 26th Street by grading to proper grade, construction of a Portland cement concrete pavement, concrete curbs, installation of necessary drainage and doing all work necessary ? to make a complete improvement; in accordance with a petition presented by the owners of seventy-five (75 0) per cent of the lineal • frontage upon the improvement and seventy-five (750) per cent of the owners of the area of the property within the improvement, requesting that the limitation of the assessment be raised to twice the assessed valuation to finance the improvement, creating a local improvement district fund therefor, and providing for the payment of said improvement by special assessment on the property in p-aid district under the mode of payment by bonds. ss WHEREAS, there has heretofore been filed with the City , Council of Everett a petition for a local improvement as hereinafter p set forth, signed by seventy-five (75o) per cent of the owners of the area within the district, and by owners of seventy-five (75%) per cent of the lineal frontage upon said improvement, requesting that such limitation of assessment be raised to twice the assessed • valuation, and WHEREAS, the said petition has been referred to the , Commissioner of Public works to be examined by said Commissioner and City Engineer, and the Commissioner of Public works has filed with the City Council all data and information required by law, and WHEREAS, said Commissioner of Public works has recommended j4• to the City Council that said improvement petitioned for be made, and it appearing to the City Council that the public health, conveniences and necessity requires that such improvement be made, • and the City Council having unanimously voted for the construction of said improvement as a public necessity. NOW, THEREFORE, ThE CITY CJIP EVERE:TT DOES ORDAIN: Section 1: That McDougall Avenue from Lverett Avenue jto 26th Street be improved by grading to proper grade, construction of a Portland cement concrete pavement, concrete curbs, installation of necessary drainage and doing all work necessary to make a complete improvement, all according to the plans and specifications prepared under the direction of the City Engineer, and which plans and specifications are hereby adopted and approved. Section 2• That the cost and expense of such improvement, including all necessary incidental expense, shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. ihe City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement except as provided by Chapter 141 Session Laws of 1923, or acts amendatory thereto and the ordinances of the City of Everett. -1-
