. <br /> t ' <br /> ORDINANCE NO. 3201 . <br /> AN ORDINANCE providing for the vacation of the follow- <br /> ing described portion of street in the City of Everett , County of <br /> Snohomish, State of Washington, to-wit: <br /> All that portion of the right of way for 9th <br /> Street lying in the Si NE4 NWT Section 17, <br /> Township 29 North, Range 5 E.W.M. , less primary <br /> State Highway No. 1 right of way; also, that <br /> portion of the right of way for 10th Street in <br /> �. that portion of the Si NE4 NW4 Section 17, <br /> Township 29 North, Range 5 E.W.M. lying east <br /> of the easterly right of way line of primary <br /> State Highway No. 1. <br /> WHEREAS, the owners of more than two-thirds of the <br /> private property abutting upon the portion of street above described' <br /> have duly filed their petition with the City Council of Everett, <br /> praying for the vacation of said portion of street; and <br /> WHEREAS, said City Council of the City of Everett did, <br /> by resolution duly adopted, fix the 26th day of May, 1948 at 10:00 <br /> o'clock A.M. of said day for the hearing and determination of said <br /> petition; and <br /> WHEREAS, due and legal notice of the time and place of <br /> said hearing and the determination of said petition has been given <br /> by the City Clerk in the manner required by law; and <br /> WHEREAS, at the time and place fixed for hearing, no <br /> persons appeared or made objections to the vacating of the herein <br /> described portion of street and no objections of any kind were made <br /> to the granting of said petition; and <br /> WHEREAS , it now appearing to the City Council that said <br /> petition should be granted and said Council does hereby determine <br /> to vacate the above described portion of street, <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the portion of street in the City of <br /> Everett, County of Snohomish, State of Washington, described as <br /> follows, to-wit : <br /> All that portion of the right of way for 9th <br /> Street lying in the Si NE4 NWT Section 17, <br /> Township 29 North, Range 5 E.W.M. , less primary <br /> State Highway No. 1 right of way; also that <br /> portion of the right of way for 10th Street in <br /> that portion of the Si NE4 NW4 Section 17, <br /> Township 29 North, Range 5 E.W.M. lying east <br /> of the easterly right of way line of primary <br /> State Highway No. 1. <br /> be, and the same is hereby vacated and the title to the land in said <br /> portion of street , above described, is hereby declared to vest in <br /> the abutting property owners as provided by law. <br /> ATTEST: Mayor <br /> Passed: 6/15/48 <br /> /;' • ty clerk Published b/16/48 <br />
