• ORDINANCE NO. 3193 . AN ORDINANCE providing for the improvement of the alley in Block 490, Plat of Everett, being the alley between Colby Avenue and vvetmore Avenue from 23rd Street to 24th Street, by the construct- ion of a Portland cement concrete pavement, full width of alley and by doing all work necessary to make a complete improvement; in accordance with a majority petition therefor; creating an assessment district; creating a local improvement district fund therefor, and providing for the payment of said improvement by special assessment on the property in said district under the mode of payment by bonds. WHEREAS, there has been heretofore filed with the City Council of the City of Everett a majority petition of the property owners petitioning for said improvement, and upon examination thereof the said City Council has found the things set forth therein to be true; and WHEREAS, the said Petition has been referred to the Commissioner of Public Works to be examined by said Commissioner and the City Engineer, and the Commissioner of Public Works has filed with the City Council all data and information required by law; and WHEREAS, said Commissioner of Public Works has recommended to the City Council that said improvement petitioned for be made, add it appearing to the City Council that the public health, convenience and necessity require that such improvement be made. NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: Section 1: That the alley in Block 490, Plat of Everett, being the alley between Colby Avenue and Wetmore tivenue from 23rd Street to 24th Street be improved by the construction of a Portland ;; cement concrete pavement, full width of alley and by doing all work necessary to make a complete improvement, all according to the plans ' and specifications prepared under the direction of the City Engineer, and which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of such improvement including all necessary incidental expense, shall be borne by and assessed against the property included in the assessment district herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement except as provided by Chapter 141 Session Laws of 1923, or acts amendatory thereto and the ordinances of the City of Everett. Section 3: That there is hereby established a local improve- ment district to be known as "Local Improvement District No. 603 ", which district shall include the following described property located in Everett, Snohomish County, Washington, to-wit: Lots 1 to 32, inclusive, Block 490, Plat of Everett. Section 4: A special fund is hereby created to be called "Local Improvement Fund No. 603 ", which shall consist in the aggregate of the several amounts assessed, levied and collected on the several lots, tracts and parcels of land in said local improvement -1-
