Li 4 ' <br /> • <br /> ORDINANCE NO. 3187 • <br /> AN ORDINANCE providing for the improvement of Baker Avenue <br /> from 23rd Street to 16th Street, and 24th Street from Wetmore Avenue <br /> to Broadway by paving the same with a 'ortland cement concrete <br /> pavement and including as a part of said work the necessary widening; <br /> providing for the necessary surface drainage; the construction or <br /> reconstruction of all sewers, side sewers, water mains and hydrants <br /> with the necessary appurtenances; the construction or reconstruction <br /> of concrete sidewalks where necessary; by such grading or regrading <br /> as may be necessary and by doing such other work as may be necessary <br /> in connection therewith to make a complete improvement, all in <br /> accordance with Resolution No. 5290 of the City of Everett; creating <br /> a local improvement district; creating a local improvement district <br /> fund therefor; providing that fifty per cent (50%) of the cost of <br /> that portion of the improvement involving grading, construction of <br /> surfacing and pavement and engineering expenses and advertising <br /> shall be paid by funds from the Washington State Development Board, <br /> the remaining cost shall be borne by and assessed against the <br /> property liable therefore as provided by law. <br /> WHEREAS, by Resolution No. 5290, the city Council of the <br /> City of Everett has declared its intention to order the improvement <br /> as above outlined, and doing all work in connection therewith to <br /> make a complete improvement in accordance with the plans and <br /> specifications as prepared by the City Engineer of the City of Everett. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That Baker Avenue from 23rd Street to 16th <br /> Street and 24th Street from Wetmore Avenue to Broadway be paved with <br /> a Portland cement concrete pavement and including as a part of said <br /> work the necessary widening; providing for the necessary surface <br /> drainage; the construction or reconstruction of all sewers, side <br /> sewers, water mains and hydrants with the necessary appurtenances; <br /> the construction or reconstruction of concrete sidewalks where <br /> necessary; by such grading or regrading as may be necessary and <br /> by doing such other work as may b e necessary in connection therewith <br /> to make a complete improvement, all according to the plans and <br /> specifications prepared under the direction of the City Engineer <br /> and which plans and specifications are hereby adopted and approved. <br /> Section 2t That the cost and expense of such improvement <br /> including all necessary and incidental expenses, shall be borne as <br /> follows: <br /> Fifty per cent (50%) of the cost of that portion of the <br /> improvement involving grading, construction of surfacing and pavement <br /> and engineering expenses and advertising shall be paid by funds from <br /> the Washington State Development Board, the remaining cost shall be <br /> borne by and assessed against the property liable therefore as <br /> provided by law. <br /> The City of Everett shall not be liable in any manner for <br /> any portion of the costs and expenses of such improvement except as <br /> provided by Chapter 141 Session Laws of 1923, or acts amendatory <br /> thereto and the ordinances of the City of Everett. <br /> -1- <br />
