All of the exhibits are available for inspection at the Hearing Examiner's Office <br /> located at 2930 Wetmore Avenue, Sth floor, Everett, Washington. <br /> After due consideration of the testimony and evidence presented by the <br /> Appellant, testimony and evidence elicited during the public hearing, and as the <br /> result of the personal inspection of the subject property and surrounding areas <br /> by the Everett Hearing Examiner, the following Findings of Fact and <br /> Conclusions constitute the basis of the decision of the Everett Hearing <br /> Examiner. <br /> FINOINGS OF FACT <br /> 1. The Applicant requested approval of a Review Process II Special <br /> Property Use PeRnit for the instailation of six panel antennas on the roof <br /> of an existing motel building at 1030 Broadway Avenue, Everett, <br /> Washington. Three antennas are located on the north end of the <br /> building and three on the south end of the building. In addition, the <br /> wireless communication facility has an electronic equipment structure I <br /> located on the ground le��el near the existing motel office.� (exhibit C-1, <br /> Tyfer testimony) <br /> 2. The subject property is zoned B-2, a zoning district that allows <br /> commercial activity. In a B-2 zone, wireless communication facilities are <br /> allowed subject to administrative approval by the City of Everett of a <br /> Review Process II Special Property Use Permit. (exhibit C-1, Tyler <br /> testimony) <br /> ,I <br /> 3. The Applicant applied for the Permit on June 15, 2000. On July 26, <br /> 2000, the City issued a Notice of Application for which a public comment <br /> period was allowed. The public comment period extended until August <br /> 9, 2000. After no public comments or appeals were received, the City <br /> determined that the proposal satisfied the requirements of the City of <br /> Everett Zoning Code, and, a Notice of Decision and the Permit were <br /> issued on August 15, 2000. (exhibit C-1, Tyler testimony) <br /> 4. The public notices that were given by the City for the project included � <br /> Notice of Application being mailed to contiguous property owners on July <br /> 26, 2000; the posting on the site, or adjacent to it, of two 24" x 36" signs <br /> describing the project on July 26, 2000; the issuance of the Notice of <br /> Decision on August 15, 2000; the mailing of the Notice of Decision to the <br /> ' The facility, including the antennas, had been constructed upon issuance of the Permit. <br /> 6 <br /> � <br />
