• <br /> A <br /> ORDINANCE NO. 3177 . <br /> AN ORDINANCE providing for the improvement of 36th Street <br /> from Wetmore Avenue to Broadway by the construction of a Portland <br /> cement concrete pavement with integral curbs, construction of concrete <br /> sidewalks where necessary, installation of necessary drainage, <br /> making necessary water main changes and necessary sidewalk, curb <br /> and alley crossing replacements and by doing all other work necessary <br /> to make a complete improvement, all in accordance with Resolution <br /> No. 5279 of the City of Everett; creating a local improvement <br /> district; creating a local improvement district fund therefor; pro- <br /> viding that fifty per cent (50%) of the cost of that portion of the <br /> improvement involving grading, construction of surfacing and pavement, <br /> engineering expenses and advertising shall be paid by funds from <br /> the + ashington State Development Board, the remaining cost shall be <br /> borne by and assessed against the property liable therefore in said <br /> district under the mode of payment by bonds . <br /> WHEREAS, by Resolution No. 5279 the City Council of the City <br /> of Everett has declared its intention to order the improvement as <br /> above outlined, and doing all work in connection therewith to make <br /> a complete improvement in accordance with the plans and specifications <br /> as prepared by the City Engineer of the City of %verett. <br /> NOSY, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That 36th Street from Wetmore Avenue to Broadway <br /> be paved with Portland cement concrete pavement with integral curbs <br /> and including as a part of such work the necessary construction of <br /> concrete sidewalks, installation of necessary drainage, making <br /> necessary water main changes and necessary sidewalk, curb and alley <br /> crossing replacements, and by doing such other work as may be neces- <br /> sary in connection therewith to make a complete improvement, all <br /> according to the plans and specifications prepared under the direction <br /> of the City Engineer and which plans and specifications are hereby <br /> adopted and approved. <br /> Section 2: That the cost and expense of such improvement <br /> including all necessary and incidental expenses, shall be borne <br /> as follows: <br /> Fifty per. cent (50%) of the cost of that portion of the <br /> improvement involving grading, construction of surfacing and pave- <br /> ment, engineering expenses and advertising shall be paid by funds <br /> from the 1rashington Stat4 Development Board, the remaining cost shall <br /> be borne by and assessed against the property liable therefor in the <br /> district herein created in accordance with law. <br /> The City of Everett shall not be liable in any manner for <br /> any portion of the costs and expenses of such improvement except <br /> as provided by Chapter 141 Session Laws of 1923, or acts amendatory <br /> thereto and the ordinances of the City of Everett. <br /> Section 3: That there is hereby established a local improve- <br /> ment district to be known as "Local Improvement District No. 595 , " <br /> which district shall include the following described property <br /> located in Everett, Snohomish County, Washington, to-wit: <br /> -1- <br />
