ORDINANCE NO. 3175 <br /> AN ORDINANCE providing for the improvement of 37th Street <br /> from Rucker Avenue to Broadway; also Oakes Avenie from 35th Street <br /> to 37th Street, by paving the same with Portland cement concrete <br /> pavement and including as part of such work the necessary widening, <br /> the installation of all needed surface drainage , the construction <br /> or reconstruction of all pavements, the construction or reconstruction <br /> of all sewers, side sewers , water mains and hydrants with necessary <br /> appurtenances , the construction or reconstruction of all concrete <br /> curbs and sidewalks where necessary, by such Trading or regrading <br /> as may be necessary, and doing such other work as may be necessary <br /> in connection therewith to make a complete improvement , all in <br /> accordance with Resolution No. 527$ of the City of Everett ; creating <br /> a local improvement district; creating a local improvement district <br /> fund therefor; providing that fifty ( 50%) per cent of the cost of <br /> that portion of the improvement involving grading, construction of <br /> surfacing and pavement and engineering expense shall be paid by the <br /> funds from the Washington State Development Board, and the balance <br /> of the cost of said improvement shall be borne by and assessed <br /> against the property liable therefor, in said district, under the <br /> mode of payment by bonds. <br /> WHEREAS , by Resolution No. 527$ the City Council of the <br /> City of Everett has declared its intention to order the improvement <br /> as above outlined, and doing all work in connection therewith to <br /> make a complete improvement in accordance with the Plans and speci- <br /> fications as prepared by the City Engineer of the City of Everett. <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That 37th Street from Rucker Avenue to <br /> Broadway; also Oakes Avenue from 35th Street to 37th Street , be <br /> improved by paving the same with Portland cement concrete pavement <br /> and including as part of such work the necessary widening, the <br /> installation of all needed surface drainage, the construction or <br /> reconstruction of all pavements, the construction or reconstruction <br /> of all sewers, side sewers, water mains and hydrants with necessary <br /> appurtenances, the construction or reconstruction of all concrete <br /> curbs and sidewalks where necessary, by such grading or regrading as <br /> may be necessary and doing such other work as may be necessary in <br /> connection therewith to make a complete improvement , all in <br /> accordance with the plans and specifications prepared under the <br /> direction of the City Engineer and which plans and specifications <br /> are hereby adopted and approved. <br /> Section 2: That the cost and expense of such improvement <br /> including all necessary and incidental expenses shall be borne as <br /> follows: <br /> Fifty ( 50%) per cent of the cost of that portion of <br /> the improvement involving grading, construction of surfacing and <br /> pavement and engineering expense shall be paid by funds from the <br /> Washington State Development Board ; the remaining cost of said <br /> improvement shall be borne by and assessed against the property <br /> liable therefor in the district herein created in accordance with <br /> law. <br /> The City of Everett shall not be liable in any manner <br /> for any portion of the costs and expenses of such improvement except <br /> - 1 - <br />
