I' <br /> ORDINANCE NO. 3168 <br /> AN ORDINANCE providing for the improvement of Oakes Avenue <br /> from 10th Street south to the Athletic Field by grading to proper <br /> grade , construction of concrete curbs and gutters , construction of <br /> a light bituminous surface treatment on roadway, construction of <br /> concrete sidewalks, installation of necessary drainage and by doing <br /> such other work as may be necessary in connection therewith to make <br /> a complete improvement , in accordance with a petition signed by the <br /> owners of more than seventy-five (754) per cent of the lineal front- <br /> age and seventy-five (75%) per cent of the area within the proposed <br /> district , petitioning for said improvement and requesting that the <br /> limits of the assessment be raised to not more than two times the <br /> assessed valuation; creating a local improvement district ; cre- <br /> ating a local improvement district fund therefor; providing that <br /> fifty ( 50%) per cent of the cost of that portion of the improvement <br /> involving grading, construction of surfacing and pavement , and en- <br /> gineering expense shall be paid by funds from the Washington State <br /> Development Board, and the balance of the cost of said improvement <br /> shall be borne by and assessed against the property liable therefor <br /> in said district under the mode of payment by bonds. <br /> WHEREAS, there has been heretofore filed with the City <br /> Council of the City of Everett a petition signed by the owners of <br /> more than seventy-five (75%) per cent of the lineal frontage and <br /> seventy-five (75%) per cent of the area within the proposed district, <br /> petitioning for said improvement, and requesting that the limits of <br /> the assessment be raised to not more than two times the assessed <br /> valuation, and upon examination thereof the City Council has found <br /> the things set forth therein to be true , and <br /> ,41-IEREAS, the Commissioner of Public Works has recommended <br /> to the City of Everett that said improvement petitioned for be made , <br /> and it appearing to the City Council that the public health, con- <br /> venience and necessity require that such improvement be made . <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That Oakes Avenue from 10th Street south <br /> to the Athletic Field be improved by grading to proper grade , con- <br /> struction of concrete curbs and gutters, construction of a light <br /> bituminous surface treatment on roadway, construction of concrete <br /> sidewalks , installation of necessary drainage , and by doing such <br /> other work as may be necessary in connection therewith to make a <br /> complete improvement , all according to the plans and specifications <br /> prepared under the direction of the City Engineer, and which plans <br /> and specifications are hereby adopted and approved. <br /> Section 2: That the cost and expense of such improve- <br /> ment , including all necessary and incidental expenses , shall he <br /> borne as follows : <br /> Fifty ( 50%) per cent of the cost of that portion of the <br /> improvement involving grading, construction of surfacing and pave- <br /> ment and engineering expense shall be paid by funds from the <br /> Washington State Development Hoard, the remaining cost of said <br /> improvement shall be borne by and assessed against the property <br /> liable therefor in the district herein created in accordance with <br /> law. <br /> The City of Everett shall not be liable in any manner <br /> for any portion of the costs and expenses of such improvements <br /> except as provided by Chapter 141 , Session Laws of 1923 , or acts <br /> - 1 - <br />
