CITY OF EVERETT SPECIAL PROVISIONS <br /> 1-05.18(3)E Safety <br /> The Contractor alone shall be responsible for safety on the job site, including, but <br /> not limited to, the safety of its and its Subcontractor's employees. The Contractor <br /> shall maintain the Project site and perform the Work in a manner that meets the <br /> City's responsibility under statutory and common law for the provision of a safe <br /> place to work. <br /> 1-05.18(3)F Threats, Intimidation and Harassment Forbidden <br /> Contractor shall not allow its employees, its Subcontractors, its Subcontractors' <br /> employees, or any other agents to threaten bodily injury or property damage, to <br /> intimidate or attempt to intimidate any person, or to assault or physically harass any <br /> person. Forbidden conduct includes, but is not limited to, threatening, appearing, <br /> or actually doing any of the following: pushing, shoving, striking, physically blocking <br /> a person or a person's vehicle, vandalism, malicious mischief, or any other act that <br /> a reasonable person would understand be intended to intimidate, cause personal <br /> injury, or cause property damage. Contractor shall remove from the job site any <br /> person reasonably under its control or direction who the Contractor or City <br /> reasonably believes violated this section. The lack of a request from the City or <br /> City's Representative to the Contractor to remove someone from the job site does <br /> not relieve the Contractor from its obligation to remove someone. <br /> 1-05.18(3)G Weapons Forbidden <br /> Contractor shall not allow its employees, its Subcontractors, its Subcontractors' <br /> employees, or any other agents or representatives to carry or possess, openly or <br /> concealed, explosives or weapons on the job site, except: (a) such explosives are <br /> as reasonably required for performance of the Work, such as those necessary for <br /> blasting or demolition work called for by the Contract Documents or (b) <br /> commissioned law enforcement officers or security personnel under authority of <br /> their commission. A weapon is any object, instrument or chemical that is (1) <br /> designed in such a manner to inflict harm or injury to another person; or(2) any item <br /> used in a manner threatening harm or injury to another person. Weapons include, <br /> but are not limited to, firearms, dangerous knives, dangerous chemicals, tear gas, <br /> martial arts weapons, blackjacks or other weapons. Further, weapons should <br /> include those described in EMC Chapter 10.78. Possession of mace, pepper spray <br /> or the like for defensive purposes is not a violation of this policy. Contractor shall <br /> remove from the job site any person reasonably under its control or direction who <br /> the Contractor or City reasonably believes violated this section. The lack of a <br /> request from the City or City's Representative to the Contractor to remove someone <br /> from the job site does not relieve the Contractor from its obligation to remove <br /> someone. <br /> 1-05.18(3)H Safety Standards <br /> The Contractor shall comply with Section 107 of the Contract Work Hours and <br /> Safety Standards Act (40 U.S.C. 327-330) as supplemented by Department of <br /> Labor Regulations (29 CFR, Part 5). Under this Section, the Contractor shall not <br /> require any laborer or mechanic to work in surroundings or under working conditions <br /> that are unsanitary, hazardous, or dangerous to its health and safety as determined <br /> under construction, safety, and health standards promulgated by the Secretary of <br /> Labor.
