Hvenue from 13th street to 10th street by paving with a Portland cement concrete pavement and from 10th street to the Golf Course by paving with a bituminous pavement/and including as a part of such work the construction of needed curbs and gutters, sidewalks, drainage, water mains and by doing such other work as may be necessar ' in connection therewith to make a complete improvement, in accordance with a petition signed by the owners of more than seventy-five (750) per cent of the lineal frontage and seventy-five (750) per cent of the area within the proposed district, petitioning for said improve- ment and requesting that the limits of the assessment be raised to not more than two times the assessed valuation; creating a loc1 improvement district ; creating a local improvement district fund therefor; providing that fifty (500) per cent of the cost of that portion of the improvement involving gracing, construction of surfacing and pavement, ana engineering expense, shall be paid by funds from the +4ashington State Levelopment Board, ana the ' balance of the cost of said improvement shall be borne by and assesse against the property liable therefor in said district under the mode of payment by bonds. HEREAS, there has been heretofore filed with the City Council of the City of Lverett a petition signed by the owners of more than seventy-five (75A per cent of the lineal frontage and seventy-five (75; ) per cent of the area within the proposed district, petitioning for said improvement and requesting that the limits of the assessment be raised to not more than two times the assessed valuation, and upon examination thereof the City Council has found the things set forth therein to be true, and WHEREAS, the Commissioner of Public Vvorks has recommended to the City of zverett that said improvement petitioned for be made, and it appearing to the City Council that the public health, con- ' venience and necessity require that such improvement be made. NO , THEREFORE, THE CITY C EV 1 E' I' DOES CRLAIN: Section 1: That Lombard Avenue, from 13th street to 10th street be paved with a Portland cement concrete pavement and 10th street to the Golf Course be paved with a bituminous pavement, ana include es a part of such work the construction of needed curbs and gutters, sidewalks, drainage, water mains and by doing suet' other worm as may be necessary in connection therewith to mane a complete improvement, all according to the plans and specifications prepared under the direction of the City Engineer, and which plans and specifications are hereby adopted and approved. Section 2: That the cost and expense of such improvement, including all necessary and incidental expenses, shall be borne as follows: Fifty (50 ) per cent of the cost of that portion of the improvement involving grading, construction of surfacing and pavement and engineering expense shall be paid by funds from the Washington State Development 3oard, the remaining cost of said improvement shall be borne by and assessed against the property -1-
