- , <br /> • <br /> ' J <br /> ORDINANCE NU. 3138 . <br /> h ordinance providing for the improvement of Lombard. <br /> Hvenue from 13th street to 10th street by paving with a Portland <br /> cement concrete pavement and from 10th street to the Golf Course by <br /> paving with a bituminous pavement/and including as a part of such <br /> work the construction of needed curbs and gutters, sidewalks, <br /> drainage, water mains and by doing such other work as may be necessar ' <br /> in connection therewith to make a complete improvement, in accordance <br /> with a petition signed by the owners of more than seventy-five (750) <br /> per cent of the lineal frontage and seventy-five (750) per cent of <br /> the area within the proposed district, petitioning for said improve- <br /> ment and requesting that the limits of the assessment be raised <br /> to not more than two times the assessed valuation; creating a loc1 <br /> improvement district ; creating a local improvement district fund <br /> therefor; providing that fifty (500) per cent of the cost of that <br /> portion of the improvement involving gracing, construction of <br /> surfacing and pavement, ana engineering expense, shall be paid <br /> by funds from the +4ashington State Levelopment Board, ana the <br /> ' balance of the cost of said improvement shall be borne by and assesse <br /> against the property liable therefor in said district under the <br /> mode of payment by bonds. <br /> HEREAS, there has been heretofore filed with the City <br /> Council of the City of Lverett a petition signed by the owners of <br /> more than seventy-five (75A per cent of the lineal frontage and <br /> seventy-five (75; ) per cent of the area within the proposed district, <br /> petitioning for said improvement and requesting that the limits of <br /> the assessment be raised to not more than two times the assessed <br /> valuation, and upon examination thereof the City Council has found <br /> the things set forth therein to be true, and <br /> WHEREAS, the Commissioner of Public Vvorks has recommended <br /> to the City of zverett that said improvement petitioned for be made, <br /> and it appearing to the City Council that the public health, con- <br /> ' venience and necessity require that such improvement be made. <br /> NO , THEREFORE, THE CITY C EV 1 E' I' DOES CRLAIN: <br /> Section 1: That Lombard Avenue, from 13th street to 10th <br /> street be paved with a Portland cement concrete pavement and 10th <br /> street to the Golf Course be paved with a bituminous pavement, ana <br /> include es a part of such work the construction of needed curbs <br /> and gutters, sidewalks, drainage, water mains and by doing suet' <br /> other worm as may be necessary in connection therewith to mane a <br /> complete improvement, all according to the plans and specifications <br /> prepared under the direction of the City Engineer, and which plans <br /> and specifications are hereby adopted and approved. <br /> Section 2: That the cost and expense of such improvement, <br /> including all necessary and incidental expenses, shall be borne <br /> as follows: <br /> Fifty (50 ) per cent of the cost of that portion of the <br /> improvement involving grading, construction of surfacing and <br /> pavement and engineering expense shall be paid by funds from the <br /> Washington State Development 3oard, the remaining cost of said <br /> improvement shall be borne by and assessed against the property <br /> -1- <br />
