r • ORDINANCE NO. 3130 . AN ORDINANCE providing for the improvement of Federal Street from Edwards Avenue to 35th Street by the construction of a sewer together with necessary appurtenances, and doing all other work as may be necessary in connection therewith to make a complete improve- ment, all in accordance with Resolution No. 5207 of the City of Everett; creating a local improvement district ; creating a local improvement district fund therefor; providing for the payment of said improvement to be made by special assessment on the property in said district under the mode of payment by bonds. WHEREAS, by Resolution No. 5207 the City Council of the City of Everett has declared its intention to order the improvement as above outlined, and to do all work in connection therewith to make a complete improvement, in accordance with the plans and specifi- cations es prepared by the City Engineer of the City of Everett ; and EEPEAS, the cost of the improvement may exceed the assessed value of the property, less improvements and less outstanding unpaid local improvement assessments; and WF3EREAS, The City Council he s by unanimous vote held the improvement to be necessary for the public health and benefit and has ordered the same . NOW, THEREFORE, Tl E CITY OF EVERETT DOES ORDAIN: Section 1: That the City Council of Everett, by unani- mous vote , finds the improvement herein described to be necessary for the public health and benefit and so orders the improvement. Section 2: That Federal Street from Edwards Avenue to 35th Street be improved by the construction of a sewer, together with necessary appurtenances, and doing all other work as may be necessary in connection therewith to make a complete improvement, all in accordance with the plans and specifications prepared under the direction of the Engineer of the City of Everett , which plans and specifications are hereby approved and adopted. Section 3: That the cost and expense of such improvement, including all necessary incidental expense , shall be borne by and assessed against the property included in the assessment aistrict herein created in accordance with law. The City of Everett shall not be liable in any manner for any portion of the costs and expenses of such improvement except as provided by Chapter 141, Session Laws of 1923, or acts amendatory thereto , and the ordinances of the City of Everett. Section 4: That there is hereby established a Local Improvement District to be known as Local Improvement District No. 583 , which district shall include the following described property, to-wit : - 1
